avalon Lord Baron of Baltemore &.a To y.e sher.r of Somrsett Co.ty Greeting whereas a Certain Randall West late of Somrsett Co.ty Planter Lately in our Co.ty Co.t of Somrsett here to witt y.e Eighteenth day of Novem.r Ann.o Dom.r one thousand Seven Hundred & twenty Eight before Sam.l Hopkins Gent & his associates then our Justices at Dividing Creek in our Co.ty afd assumed upon himselfe & did undertake for a Certain W.m West Late of Somrsett Co.ty Planter that in Case a Certain W.m Hopkins Should recover Judgm.t Against y.e afd W.m West in a Certain Plea of trespass upon y.e Case &.a by y.e same Wm Hopkins Against y.e afd W.m West in our same Court Prosecuted or yt y.e same W.m Should be therein Convict that then y.e same W.m all the Dam.s which to y.e same W.m Hopkins in our same Court here in the Plea afd Plea of trespass upon y.e Case &.a that Should be Adjudged would Satisife or his Body in Execution of Such Judgm.t to y.e Sher of Somrsett Co.ty would Render or yt he y.e s.d Randall West would do the Same for him & altho' y.e afd W.m Hopkins afterwards to witt y.e Seventeenth day of June Ann.o Dom.r one thousand Seven Hundred & twenty Nine in our Same Court before y.e same Sam.l Hopkins Gent & his associates then our Justices of Somrsett Co.ty Co.t at Dividing Creek afd & by Consideration of y.e same Court Recovered Against the afd W.m West Nine Hundred & Eleven & a halfe Pounds of tob.o for his Dam.s which he Sustained by Occasion of a Certain Promise & assumption to y.e same W.m Hopkins by y.e afd W.m West Made & Not Performed whereof he is Convict as by the Records & Proceedings thereof in our same Court before our Justices at Dividing Creek afd Manifestly appeareth Nevertheless y.e afd W.m West his Body in Execution of Such Judgm.t to y.e afd Sher of Somrsett Co.ty hath not rendered Nor y.e same W.m West the Dam.s afd to y.e afd W.m Hopkins hath not Satisfied Neither hath y.e afd randall Done the Same for him as by y.e Insinuation of the afd W.m Hopkins we have received & because we are Willing yt those things which in our s.d Co.t are rightfully Acted & Acknowledged Ought to be duly Executed we Command you yt by Honest & Lawfull Men of your Balywick you Make Known unto y.e afd Rand.l West that he be & appear before our Justices of our Coty Co.t of Somrsett to be Held at Dividing Creek y.e third tuesday of June Nextto Shew Cause if any thing for himselfe he Hath or Knoweth to say wherefore y.e afd W.m Hopkins his Execution Against him of y.e Dam.s afd to have Ought not According to y.e form of y.e Recognizance afd if unto him it Shall Seem Expedient & Have you then & there the Names of them by whom to him you Make y.e Same Known & this Writt Wittness W.m Planner Gent on of our Justices of our s.d Co.t y.e twentyeth day of March in y.e Sixteenth Year of our Dominion &.a Ann.o Dom.r one thousand Seven Hundred & thirty twenty Nine Att which said third tuesday of June to witt y.e Sixteenth Day of y.e same Month Ann.o Dom.r one thousand Seven Hundred & thirty being y.e Day of y.e return of the said Writt Cometh the said W.m Hopkins by his attry afd & the Sher of Somrsett Co.ty (to witt) Jn.o Purnell Gent.m at y.e same Day Returned that he by virtue of y.e Writt afd to him Directed had Made Known to y.e afd Rand.l West by Hugh Porter and Jn.o Doe Honest & Lawfull Men of his Balywick that he be before the Justices of his Lordships (Coty) |
