263 Maryland & avalon Lord Baron of Baltemore &.a To y.e sher of Somrsett Co.ty Greeting whereas a Certain Rand.l West Late of Somrsett Co.ty Planter Lately in our Co.ty Co.t of Somrsett here to witt y.e Nineteenth day of Novem.r Ann.o Dom one thousand Seven Hundred & twenty Eight before Saml Hopkins Gent & his associates then our Justices at Dividing Creek in our Co.ty afd assumed upon himselfe & did undertake for a Certain W.m West Late of Somrsett Co.ty Planter that in Case a Certain Tho.s Dashiell Should Recover Judgm.t against y.e afd W.m in a Certain Plea of trespass upon y.e Case &.c by y.e Same Tho.s against y.e afd W.m in our same Court Prosecuted or that the Same W.m Should be therein Convict that then y.e same W.m all the Dam.s which to the same Tho.s in our same Co.t here in y.e afd Plea of trespass upon y.e Case &.a that Should be Adjudged would Satisfie or his Body in Execution of Such Judgm.t to y.e Sher of Somrsett Co.ty would Render or that he y.e s.d Rand.l West would do the Same for him altho' y.e afd Tho.s afterwards to witt y.e Seventeenth Day of June Ann.o Dom.r one thousand Seven Hundred & twenty Nine in our Same Court recovered against before y.e same Sam.l Hopkins Gent & his associates then our Justices of Somrsett Co.ty Co.t at Dividing Creek afd & by Consideration of y.e same Co.t Recovered Against y.e afd W.m West twelve Hundred & forty pd.s of tob.o for his Dam.s which he Sustained as well by Occasion of a Certain Promise & assumption to y.e same Tho.s by y.e afd Will.m Made & Not Performed whereof he is Convict as by the Records & Proceedings thereof in our Same Co.t before our Justices at Dividing Creek afd Manifestly appeareth Nevertheless y.e afd W.m his Body in Execution of Such Judgment to y.e afd Sher of Somrsett Co.ty hath not rendered nor y.e same W.m the Dam.s afd to y.e afd Tho.s hath not Satisfied Neither Hath the afd Rand.l Done the Same for him as by y.e Insinuation of y.e afd Tho.s we have received & because we are William that those things which in our s.d Co.t are rightfully Acted & Acknowledged Ought to be duly Executed we Command you that by Honest & Lawfull Men of your Balywick you Make Known unto y.e afd Rand.l West that he be & appear before our Justices of our Co.ty Co.t of Somrsett to be Held at Dividing Creek y.e third tuesday of June Nextto Shew Cause if any thing for himselfe he Hath or Knoweth to say wherefore y.e afd Tho.s his Execution against him of y.e Dam.s afd to Have Ought not According to the form of y.e Recognizance afd if unto him it Shall Seem Expedient & have you then & there the Names of them by whom to him You Make y.e same Recover & this Writt Wittness W.m Planner Gent one of our Justices of our s.d Co.t y.e twentyeth Day of March in the Sixteenth Year of our Dominion &a Ann.o Dom.r One thousand Seven Hundred and twenty Nine Att which said third tuesday of June to Witt the Sixteenth Day of y.e same Month Ann.o Dom.r one thousand Seven Hundred & thirty being the Day of the Return of y.e Writt Cometh the said Tho.s Dashiell by his attry afd & y.e Sher of Somrsett Co.ty (to witt) Jn.o Purnell Gent.m at y.e same day Returned that he by Virtue of y.e Writt afd to him Directed he had Made Known to the afd Rand.l West by Hugh Porter & Jn.o Doe Honest & Lawfull Men of his Balywick that he be before the Justices of his Lordships Co.ty Co.t of Somrsett at the Day & Place afd to shew &.a as to him it was Commanded And the afd Randall West so fore Warned And at the Same Day solemnly Called Cometh Not but Makes Default Therefore it is Considered that the afd Tho.s Dashiell have his Execution against the afd Randall West of the Dam.s afd According to the force form & Effect of the Recognizance afd also that y.e said Tho.s Dashiell According to the form of the Statute (350) in Such Case Lately Made & Provided Recover against the afd Rand.l West two |
