County Court of Somrsett at y.e Day & Place afd to shew &.a as to him it was Commanded

                        And the afd Randall West so forewarned and at the same Day Solemnly
Called Cometh Not but Makes Default

                        Therefore it is Considered that y.e afd W.m Hopkins have his Execution against y.e
afd Randall West of y.e Dam.s afd According to y.e force form & Effect of y.e Recognizance
afd also that y.e said W.m Hopkins According to y.e form of y.e statute in Such Case lately made
(253)   & Provided Recover Against the afd Randall West
Pounds of tob.o for his Costs Charges & Dam.s which he Sustained by Occasion of Delay
of Execution of the Dam.s afd &a

     This being an Action of trespass upon the Case &.c  Wherein the Sher of Somersett
County to whom the Writt in y.e same Action was Directed Comes & Makes
Return thereof to y.e Court here Endorsed viz.t
                                                                Cepi Corpus decl.n delivered in time   P.r Jn.o Purnell sher
                         Whereupon y.e afd Abraham Smith being Called appears & thereupon y.e said
Abraham Smith at the Prayer of the Plfts attry afd is adjudged to Give Special Bail to the Action
afd Thereupon a Certain Tho.s Fletcher of Somrsett County Gent Present herein Court in his own
Proper Person undertakes for the said Abraham Smith that if in Case the afd Jn.o Murray Shall
Recover Judgm.t in the Plea afd against y.e afd Abraham Smith or that the said Abraham Smith
Should be therein Convict that then he y.e said Abraham Smith Shall Pay the Condemnation of y.e Court
thereupon or render his C Body to y.e Custody of y.e sher of Somrsett Co.ty in Satisfaction thereof or that
he y.e said Tho.s Fletcher will do it for him        Thereupon y.e said Abraham Smith by Jam.s Shirley
his attry appears & Imparles till Next Court &c

Rebecca Cornwallis Exrx & Jn.o May Ex.r of W.m Cornwallis May
Give Security for Costs in Case Nonsuite be Obtained Against them
                                                     in the Plea afd which is by the Court Granted  Thereupon a Certain John
    Donelson of Somrsett County Gent.m undertakes for y.e said Rebecca Cornwallis Exrx & Jn.o May
Ex.r of W.m Cornwallis that in Case they be Nonsuited in y.e Plea afd or Otherwise Legally Cast that
then they y.e said Rebecca Cornwallis Exrx & Jn.o May Ex.r of W.m Cornwallis Shall Pay y.e Condemnation
of the Court & all Costs Accrewing thereon to y.e s.d  James Shirley or that the said Jn.o Donelson
will do it for them &a

the deft the tenor whereof followeth in these words vizt
Somersett ss.  Charles absolute Lord and Proprietary of the provinces of Maryland and
                                     avalon Lord Baron of Baltemore &.c  To the Sherr of Somersett County Greeting Whereas Joseph   
    MaClester Lately in our Co.ty Co.t of Somrsett here to witt y.e twenty first Day of Novem.r one thousand
Seven Hundred & twenty Seven before Sam.l Hopkins Gent & his associates then our Justices of our
said Court at Dividing Creek by Consideration of y.e same Court Recovered Against Rob.t Ware
Late of Somrsett County Planter two thousand one Hundred & Eighty one Pounds of tob.o
for his Dam.s which he Sustained by Occasion of a Certain Promise & assumption to y.e same Jos:
by y.e afd Robert Lately Made & not Performed whereof he is Convict as by y.e Record & Process
thereof in our same Court remaining before our s.d  Justices at Dividing Creek Manifestly appeareth
