       June Court    1730                 262

James Gibbens son of James Gibbens late of Somersett County dec.d being arrived at full age for the Chosing of
his Guardian Comes here into Court and prays that he may be admitted to Chose a Certain James Caldwell his Guardian
which is granted &.c he giving Good Security to Comply with the law relating to Guardians &c

       And further it is Ordered by the Court that a Certain Joseph Venables of Somersett County Gentm (who has
the Estate of the said James Gibbins in his hands) deliver up unto the afd James Caldwell all the Estate of the afd
James Gibbens that he hath in his hands both reall and personall &c

                   Whereupon the afd James Caldwell together with John Caldwell and Ebenezer Handy his Securitys
all present herein Court in their proper persons acknowledge themselves to we and Stand Justly Indebted
unto the said James Gibbens in One hundred pounds Sterling good and Lawfull money of England Joyntly and
Seperately to be made and Levied for the Use of the afd James Gibbens his heirs or assigns if default be made in
the Condition hereunder written

                                                                The Condition of the above Recognizances is Such that if the above
bounden James Caldwell will do and shall well and truely Comply with the Law in Relation to Guardians and
when the Said James Gibbins shall arrive at full age to receive his Estate that then he the Said James Caldwell his
heirs Executors of administrators shall deliver the Same ^unto the said James Gibbins his heirs or assignes^ quietly and Peaceably without fraud or delay &c then the
above Recognizance to be void and of None Effect Otherwise to remain in full force and vertue &c

                  Whereupon the afd James Caldwell together with John Caldwell and Ebenezer Handy of the County
afd Gentm.t Securitys present herein Court in their proper persons and acknowledged themselves to owe and
stand Justly Indebted unto the afd John Gibbens in the full and Just Sum of One hundred pounds Sterling good
and Lawfull money of England Joyntly and Seperately ^of their goods & Chattells Lands or tenements^ to be made and Levied for the use of the afd John Gibbens
his heirs or assigns if default be made in the Condition hereunder written

             The Condition of the above Recognizance is such that if the above bounden James Caldwell his heirs
    Executors or administrators do and shall well and truly Comply with the law Relating to Guardians and
likewise deliver up unto the afd John Gibbens his heirs or assigns all his Estate that he hath in his hands both
Reall and personall peaceably and quietly without fraud or further delay then the above Recognizance
to be void and of None Effect otherwise to Stand and remain in full force and vertue in Law &c

                                         To the worshipfull Justices for the County afd in Court now
                Setting the Humble Petition of W.m Poynter Most Humbly Sheweth'
that whereas your Worships did Bind to your Petitioner ^an^ orphan boy Called
             Nehemiah Poynter & there is Now Due to the afd Orphant the one third of his
Brother dec.ds Estate which Now Layes in the Hands of Abraham Smith & Dennis Hudson
& the same Will not Deliver without Your Worships Order which your Worships Petitioner
Humbly Pray's and Your Worships Petitioner as in Duty Bound Shall Ever
Pray for your Worships                                                               W.m Poynter

                                                        Upon Reading the Petition afd and all and Singular the Premises Considered
       Wherefore it is ordered by the Court that the afd Abraham Smith and Dennis Hudson deliver up unto the afd William
       Pointer one third of the Estate of Jeremiah Pointer decd (which they have in their hands; and now belongs to an orphan
       Called Nehemiah Pointer in the Custody of the afd William Pointer) lett it be of what kind soever     and further
        it is ordered by the Court that the afd William Pointer give Security for the Safe keeping of the afd Estate to be
