1730 261 it the Ceader Post now in his veiw Stands Erected was a Stump of y.e second Bounder of Chuckatuck Land & that a Certain Jn.o Serjant who formerly Levied upon y.e s.d Land had Cutt y.e s.d tree Down & that one Phillip Conner or Conaway Had Proved the said tree as a Second Bounder & further Saith Not Thomas Peal Jn.o Scott Francis Allen
of a tract of Land Lying in y.e Co.ty afd Containing three Hundred & forty three Acres Called Powells Lott we therefore require you or any three or two of you at some time and Place as to you or any three or two of you Shall Seem Convenient you Meet on the afd Land Called Powells Lott (you first haveing taken your Oath on the Holy Evangelist of Almighty God According to Act of assembly in Such Case made & Provided) & there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you Nominated by y.e s.d Complaniant (or Deft if any) & yt you Examine them upon their Corporall Oaths to be by you or any three or two of You Administred on y.e Holy Evangelist of Almighty God in Prsents of y.e Complaniant (or Deft if any) touching y.e truth or remembrances of their Knowledge or any thing that may relate to y.e Cause afd & that reduceing the Severall Depositions Into Writing you send y.e same together with this our Commission under your or any three or two of your hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness W.m Planner Gent one of our Justices of our s.d Co.t &c On y.e Backside of y.e foregoing Commission it was thus Endorsed viz.t This Day to witt y.e fourteenth Day of May Ann.o Dom.r 1730 Jn.o Miller and Jn.o Tull was Duly Qualified to Act According to the within Commission before me The Execution of the within Commission appears by the affidavitt W.m Fasitt thereunto Annexed as wittness our Hands Jn.o Miller, Jn.o Tull Somrsett Co.t ss In Obedience to a Commission Directed to Jn.o Smith, Jn.o Miller W.m Smith & Jn.o Tull or any three or two of them to Examine Evidences in relation to y.e Bounds of A tract of Land Called Powells Lott we y.e Subscribers Have Mett on y.e said Land this fourteenth day of May Ann.o Dom.r 1730 first being Quallified or Sworne before one Justice of the Peace do Proceed to y.e Examination of Evidences as Followeth Hugh Tingle Sen.r Aged 76 years or theirabouts being Sworne & Examined Saith he heard Walter Powill & Walter Evans Say that y.e first Bounder of Powells Lott was the first Bounder of a tract of Land Called Winter Quarter where they Begun to y.e Best of his Knowledge he Shewed us a white Oak Marked with y.e Surveyers Marke Standing Near y.e side of Herring Creek & by y.e side of a field where Tho.s Cottin Now Lives where he Saith to y.e Best of his Knowledge he Marked y.e s.d tree and further Saith Not This Evidence taken by us this Day & Date abovesaid as Wittness our hands and Seals Jn.o MIller (seal) Jn.o Tull (seal) |
