of the parties afd Referred to the said William Holland and John Scarbrough of the County afd Gent.m according
to the form of the Statute and Judgm.t to be given on the return as of this Court afterwards the Same day
and year Last mentioned Came hereinto Court the said William Holland and John Scarbrough and makes
Return of their award in the premisses afd as followeth viz.t
                                                                                             We the Subscribers do find William Benston
to be Indebted to William Marchment four pounds Nine shillings and ten pence Curr.t money of Maryland
with Costs of Suit as wittness our hands         W.m Holland   Jno Scarbrough                 which being read
and heard      Therefore it is Considered that the afd William Marchment Recover against the afd
William Benston his damages afd to the afd four pounds Nine shillings and ten pence Currant money of
237   Maryland by the arbitratros afd in form afd found as also two hundred & thirty Seven          pounds
of tobacco for his Costs and Charges to the Same Will.m Marchment by the Court hereof his assent adjudged
and the afd Deft in Mercy &c

Attached to answer unto Tho.s Rowe of a plea of trespass upon y.e Case &a
    And whereupon y.e same Tho.s Row by Levin Gale his attry
                     Complains that whereas y.e afd W.m y.e tenth day of Novem.r Seventeen Hundred
      & twenty Eight at Somrsett Co.ty within y.e Jur of this Co.t was Indebted unto y.e same
Tho.s in y.e sum of two pd.s Nine Shill.s Curr.t Mony as by Acc.t herewithin Co.t Produced
may appear & so thereof being Indebted y.e said W.m in Consideration thereof afterwards
to witt y.e same Day & Year afd at y.e Co.ty afd within y.e afd Jur upon himselfe assumed
& to the same Tho.s then & there faithfully did Promise yt he when afterwards
to witt y.e same day & Year afd at y.e Co.ty afd and within y.e afd Jur by y.e same Thomas
was thereto requested but he y.e same to do hath altogether refused & Still doth refuse
whereby y.e same Tho.s Rowe say's he is worse & Hath Damage to y.e value of five
pd.s Curr.t mony & thereof he brings this suite &a     L Gale P Quer pledges &.a  J Doe R Roe

and Injury when &.a  And says that he Cannot Gainsay the Action afd of the afd Tho.s Rowe
Nor but that he did assume upon himselfe in Manner & form as the afd Thomas rowe
above against him Hath Complained & as to y.e Dam of y.e same Tho.s by him by Occasion
of y.e Premisses in that part Sustained the same W.m says & Confesseth yt y.e afd
Tho.s has Sustained Damage by Occasion of y.e Premisses beyond his Costs and
Charges by him about his Suite in that Part apposed to two pounds Nine Shill.s
Curr.t Mony & Not More & Because y.e afd Tho.s Row Deny's not this but the
