 Somersett County fs  William Benston late of Somersett County planter al.s dict
William Benston of the County afd Planter was Sumoned to Answer unto
William Marchment of a plea of broach of Covenant &c
and whereupon the said William Marchment by francis Allen his attorney saith that whereas
the afd William Benston by the name of William Benston of the County afd Planter the third day
of March Ann.o Dom.r Seventeen Hundred & twenty Eight by Certain Articles of Agreem.t
which y.e s.d W.m Marchment with y.e seal of y.e said W.m Benston Signed hereinto Co.t
Brings the Date whereof is the same Day & Year at the County of Somrsett afd within
the Jur of this Co.t did Oblidge himselfe to saw with y.e afd W.m Marchment Six
Months with the Whip Saw from that time & for every Day that he Should be
absent from Sawing to forfeit One Shill.s & Eight pence Curr.t Mony of this
Province of Maryland for & in Consideration of Nine Pounds in Country pay
to be paid him by y.e s.d W.m Marchment with Dyett Washing & Lodging during
the term & y.e afd W.m Marchment in fact Saith yt he y.e said Will.m Marchm.t
always was ready to Pform y.e Covenants & agreements on his part to be Pformed
& Kept According to y.e form & Effect of y.e s.d Writing & yt he y.e s.d W.m Benston
hath not Workt with him y.e s.d W.m Marchment by the Space of Six Months
at y.e Whip saw but hath Broken y.e Articles of agreem.t afd & absented himselfe
Ever Since the thirtyeth Day of March afd in y.e year afd & y.e s.d Articles
of Agreement on his part & Behalfe to be Pformed & Kept According to y.e force
form & Effect of y.e s.d Writing hath not Kept & Pformed but the same to Keep
& Pform hath refused & Still doth refuse & Deny Whereupon y.e s.d Will.m
Marchment Saith he is worse & Hath Damage to the value of twenty pd.s
Curr.t Mony of Maryland & thereupon he Brings Suite &a
                                                       F: Allen P Quer Pledges &.a J Doe R Roe

And the afd W.m Benston in his own Proper Person Comes & Defends y.e force
and Injury when &.a  And Prays Leave to Imparle hereunto untill the Next
Court and he hath it & the same Day is Given to the afd Plft here also &a

        Att which said Next Court to witt the Nineteenth day of August Ann.o Dom.r
one thousand Seven Hundred & twenty Nine Came Again as well the afd William
Marchment ^by his attry afd^ as y.e afd W.m Benston in his Own proper Person & the afd Will.m
Benston ^in his own^ as before ^proper person and^ Defends the force & Injury Prays further Leave to
Imparle hereunto untill y.e Next Co.t & he hath it & the same Day is Given to
the afd Plft here also &a

          Att which said Next Co.t to witt the Eighteenth day of Novem.r Ann.o Dom.r one
thousand Seven Hundred & twenty Nine Came Again as well y.e afd W.m Marchment
by his attry afd as afd as y.e afd W.m Benston in his own Proper person & y.e afd
W.m Benston as before Defends the force & Injury Prays further Leave to
Imparle hereunto untill y.e Next Court & he hath it & y.e same Day is Given
to y.e afd Plft here also &a

    Att which said Next Court to witt y.e seventeenth Day of March Ann.o Dom
one thousand Seven Hundred & thirty twenty Nine Came Again as well y.e
