254 Same Alligation Confesseth to be true Prays Judgm.t & those Damages above Confessed together with his Costs & Charges afd to him adjudged &a Therefore it is Considered by Consent of the Parties afd yt y.e afd Tho.s Rowe Recover against y.e afd W.m Bozman two pounds Nine Shill.s Curr.t mony his Damages afd by y.e same W.m Bozman in form afd Confessed as also Two hundred & seven 207 pounds of tob.o for his Costs & Charges afd to y.e same Thomas at his request by y.e Court here & by Consent of y.e Parties afd adjudged which Certain Damages in y.e whole do amount to two pounds Nine Shill.s Curr.t mony & Two hundred & seven pounds of tob.o & y.e afd Deft in Mercy &a
& twenty Eight at Somrsett Co.ty within y.e Jur of this Co.t was Indebted unto y.e same George in the Sum of Six Hundred & Sixty one pounds of tob.o & twenty Eight Bushells of Indian Corn for Divers Goods wares & Marchandizes sold & Delivered him & so thereof being Indebted y.e said Walter in Consideration thereof afterwards to witt y.e same Day & Year afd at y.e Co.ty afd within y.e afd Jur upon himselfe assumed & to y.e same Geo: Gale then & there faithfully did Promise that he when afterwards he shou'd thereto be requester y.e afd Sum of Six Hundred & Sixty one pounds of tob.o & twenty Eight Bushells Corn to y.e same Geo: Gale he wou'd well & faithfully Content & pay Nevertheless y.e same Walter His promise & assumption afd in form afd Made Little regarding but Plotting & fraudulently Intending him y.e said George in that Part Craftilly & Subtilly to Defraud & Deceive he y.e afd Sum of Six Hundred & Sixty one pd.s of tob.o & twenty Eight Bushells of Corn nor any part thereof to y.e Same Geo: Gale hath not Paid or him for it in any wise Contented altho y.e said Walter y.e same to Doe afterwards to witt y.e same Day & Year afd at y.e Co.ty afd & within y.e afd Jur by y.e same Geo: was thereto requested but he y.e same to Do hath altogether refused & Still doth refuse whereby y.e same George Say's he is worse and Hath Damage to y.e value of one thousand pounds of tob.o & forty Bushells of Indian Corn & thereof he brings this Suite &a L: Gale P Quer Pledges &.a J Doe R Roe Whereupon y.e said Walter Jacobs in his Own Proper Person Comes and Defends y.e force & Injury when &.a And says ^that^ he Cannot Gainsay y.e Action afd of y.e afd Geo: Gale nor but yt he did assume upon himselfe in Manner & form as y.e afd Geo: Gale above Against him Hath Complained & as to y.e Damage of y.e same George by him by Occasion of the Premisses in that part Sustained y.e same Walter says & Confesseth that y.e afd George has Sustained Damage by Occasion of the Premisses beyond his Costs & Charges by him aboute his Suite in that Part apposed to Six Hundred & Sixty one pounds of tob.o & twenty Eight Bushells of Indian Corn & Not More & Because y.e afd Geo: Gale denys not this but the same Alligation Confesseth to be true Pray's Judgm.t & those Damages above Confessed together with his Costs & Charges afd to him adjudged &a Therefore it is Considered by Consent of y.e Parties afd that y.e afd Geo Gale (Recover) |
