252 Whereas a Certain Philip Russell of Sussux County upon delaware hath Obtained an Injunction to Stay proceedings at Law on a Judgmt Rendred against him in Somersett County Court upon a Suit by him ^ex^hibited in Said Court against the Said James Shirley for the Sum of fourteen pounds fifteen shillings and Eleven pence Lawfull money of america by James Shirley upon the verdict of a Jury thereupon found against him the said Philip Now the Condition of the above Obligation is such that if the Said Philip RUssell shall Prossecute the Said Philip Russell Writt of Injunction with Effect and Satisfie and pay to the Said James the Sum of Six hundred and Eighty two pounds of tobacco his Costs in the Said Court adjudged against the Said Philip as also all Costs and damages and Charges that shall accrew in the Chancery Court or to be Occasioned by ^the^ delay of Execution on the Said Judgmt unless the Cort of Chancery shall decree to the Contrary and shall in all things Obey such order and decree as the Chancery Court shall make in the premisses then the above obligation to be Void and of None Effect else to be in full force and vertue Sealed and delivered In the presence of us J Donelson Thomas Hayward Francis Allen ordered by the Court that the following account and probatt may be recorded viz.t
Subter is C.r By my note £8..17..06 On the back side of the foregoeing account it was thus Endorsed March y.e 20.th 1729 Then Came into Open Court James Shirley in his proper person and did then and there before William Planner Gent and Others his Associates Justices of the Same Court Judicially Sitting make Oath upon the holy Evangelist of Almighty God that the within account as it stands Stated against Philip Russells is Just and true and that he had Received noe part nor percell thereof save Creditt Given In testimony whereof I have hereunto sett my hand the day & Year abovesaid Thomas Hayward Clk Cur Coun Saml
him in the plea afd which is by the Court Granted thereupon a Certain William Marchment of Somersett County planter present here in Court undertakes for the afd John Williamson that in Case she he be Nonsuited in the plea afd or otherwise Legally Cast that then the said John Williamson shall pay the Condemnation of the Court and all Costs accrewing thereon to the Said Nathaniel Horsey or that he the Said William Marchment will do it for him &c |
