251 and he hath it & the same Day is Given to y.e afd Plft here also &a Att which said Next Court to witt y.e seventeenth Day of March Ann.o Dom one thousand seven hundred & twenty Nine Came again as well y.e afd Jn.o Onorton by his said attry ^afd^ as y.e afd Jn.o Bishop by George Dashiell his attorney and the afd John Biship by his said attorney as before defends the force and Injury when &.c and says that he Cannot Gainsay y.e Action afd of y.e afd Jn.o Onorton nor but that he did assume upon himselfe in Manner & form as y.e afd Jn.o Onorton above Against him hath Complained & as to y.e Damage of y.e said Jn.o Onorton by him by Occasion of y.e Premisses in that Part Sustained y.e same Jn.o Say Bishop Say's & Confesseth that y.e afd Jn.o Onorton has Sustained Dam by Occasion of y.e Premisses beyond his Costs & Charges by him about his suite in yt part opposed to three pounds Curr.t Mony & Not More & because y.e afd Jn.o Onorton deny's not this but y.e same Alligation Confesseth to be true Prays Judgm.t & those Dam.s above Confessed together with his Costs & Charges afd to him adjudged &.a Therefore it is Considered by Consent of y.e Parties afd yt y.e afd Jno Onorton recover against y.e afd Jn.o Bishop three pd.s Curr.t Mony his Damages afd by y.e same Jn.o Bishop in form afd Confessed as also Two hundred & thirty Nine pounds of tob.o for his Costs & Charges afd to y.e same Jn.o Onorton at his request by y.e Court here & by Consent of y.e Parties afd adjudged which Certain Damage in y.e whole do Amount to three pounds Curr.t Mony & Two hundred & thirty Nine pounds of tob.o and y.e afd Deft in Mercy &.a
she be non Suited in the plea afd or Otherwise Legally Costs that then the said Ann Cox shall pay the Condemnation of the Court and all Costs accrewing thereon to the said Charles Croson or that the Said Fran: Allen will do it for him &c
