250 Defends the force & Injury when &a And saith that he is not Guilty of ye tres [illegible] assault above imposed upon him in Manner & form as ye Plft against him [illegible] Complained & of this he putts himselfe upon ye Country & ye Plft in Like Manner Thereupon Command is Given to ye sher of Somrsett Co.ty that Immediately he Cause to Come here twelve &.a by whom &.a who Neither &.a to recognize &.a because as well &.a of which said Precept ye s.d Sher to witt Jn.o Purnell Gent Now here at this Day to witt ye same Day & Year Last Mentioned Comes & Makes return that he hath here ready twelve &.a as by his said Precept he was Commanded & Now hereafterwards to witt ye same day & Year Came as well ye afd Francis Porter as ye afd Benj.a Bishop by their attrys afd & ye Jurors of that Jury therein Impannelled being Called Likewise Came to witt W.m Handy, W.m Turpin Jun.r Geo: Benston, Jos: Gray, Jn.o Scarborough, Jn.o Atkinson, Jn.o White Abra: Owtten, Jn.o Murray Aaron Linn, Robert Mitchell & Benj.a Houston who being duely Elected tryed and Sworn to say the truth in the premises afd upon their Oath do say that the afd Benjamin Bishop is guilty of the trespass assault and Battery as the afd Francis Porter above against him hath Complained and assessed the damages of of the same Francis by Occasion of the trespass assault and batter afd to ten shillings Currant money and for his Costs and Charges by him about his Suit on that part apposed to One pound of tobacco and for as much as ^it appeareth to ye Court here that^ the Battery afd was well proved &.c Therefore it is Considered that the afd Francis Porter recover against the afd Ben.a Bishop ten Shill.s Curr.t Mony & one pound of tob.o his Damages afd by 1079 ye Jurors afd in form afd assessed as also one thousand & Seventy Nine pounds of tob.o for his Costs & Charges afd by ye Court here to ye same Francis ^of Increase^ adjudged which Certain Damages in the whole do Amount to ten Shill.s Curr.t Mony & one thousand & Seventy Nine Pounds of tob.o & the afd Benj.a Bishop be taken &a
the said John Bishop the day of Anno Dom One thousand Seven hundred & twenty at Somersett County aforesaid within the Jurisdiction of this Court was Indebted unto the said John Onorton in three pounds Curr.t money of Maryland as by note by the said John Bishop Signed May appear & Being so thereof Indebted ye s.d Jn.o Bishop in Consideration thereof ye day & Year afd at ye s.d place afd upon himselfe did assume & to ye s.d Jn.o Onorton then & there did faithfully Promise yt he ye s.d Jn.o Bishop ye s.d three pd.s to ye s.d Jn.o Onorton when he shou'd be afterwards thereunto requested he would well & faithfully Pay & Content Nevertheless ye s.d Jn.o Bishop his Promise & assumption afd in form afd made Nothing regarding but plotting & fraudulently Intending ye s.d Jn.o Onorton in yt p.t Craftilly & Subtilly to deceive & Defraud ye s.d three pd.s to ye s.d Jn.o Onorton tho' often by him thereunto requested hath not paid but ye same to him hitherto to pay hath refused & Still Doth refuse & Deny Whereupon he Saith he is worse & hath Damage to ye value of Six Pounds Mony afd & thereupon he Brings Suite &a Francis Allen P Quer Pledges &.a J Doe R Roe And the afd Jn.o Bishop in his own Proper Person Comes & Defends ye force & Injury when &.a And Prays Leave to Imparle hereunto untill the Next Court (and) |
