1729 250 Jn.o by their attrys afd and the Same attorney of the afd John says that he is not Informed by the same John his Clyant of any answer for the same deft to the afd plft in the plea afd to be given and nothing els thereof says ^by^ which the same plft Remaineth against the afd deft thereof undefended &c Whereupon the afd Plft his damages by Occasion of the non performance of the promise and assumption afd against the afd deft Ought to recover &.c Whereupon at the prayer of the afd Plantife and with ye Consent of the afd deft the Justices here according to act of assembly in such Case made and provided assessed the damages of the Same plft by Occasion of the Non performance of the promise and assumption afd besides his Costs and Charges by him about his Suit in that part Expended to four pounds Curr.t money and two hundred and three pounds of tobacco &c Therefore it is Considered that the afd Joseph MccClester Recovered against the afd John Bliz.d four pounds Curr.t mony and two hundred and three pounds of tobacco his damages afd by the Justices afd in form afd assessed as also Two hundred & Twenty four 224 pounds of tobacco for his Costs and Charges by him about his Suit in that part Expended by the Court here of his assent adjudged and the afd deft in Mercy &c
Intreat so yt of his Life it was Greatly Dispaired & Other Harms to him ye s.d Francis then & there did to ye Great Damage of him the s.d Francis & against ye Peace of the right honrble ye Lord Propry yt Now is his Good rule & Governm.t &a And Whereupon ye s.d Francis Porter by Francis Allen his attry Complaines yt ye s.d Benj.a ye Eighth day of August Ann.o Dom.r One thousand Seven Hundred & twenty Nine at Snow Hill town in Somrsett Co.ty afd within ye Jur of this Court with force & arms &.a viz.t with fists & feet in & upon him ye s.d Francis Porter then being Constable of Pocomoke Hundred in ye Execution of his s.d office of Constable in ye Peace of God & of ye right honrble ye Lord Propry of this Province then & there Being an assault he did Make & Him did Beat wound & Evill Entreat Other Harms to Him did to ye Great Damage of ye s.d Francis Porter & Against ye Peace of ye s.d Right honrble ye Lord Propry his Good rule & Governm.t Whereupon ye s.d Francis Porter Saith he is worse & hath Dam.s to ye value of twenty pounds Curr.t Mony of Maryland & there upon he Brings Suite &.a Francis Allen P Quer Pledges &a J Doe R Roe And the afd Benj.a Bishop by Geo: Dashiell his attry Comes & Defends the force & Injury when &.a And Prays Leave to Imparle Hereunto untill ye Next Court & he hath it and ye Same Day is Given to ye afd Plft here also &a Att which said Next Court to witt ye Eighteenth Day of Novem.r Ann.o Dom one thousand Seven Hundred & twenty Nine Came Again as well ye afd Francis Porter as ye afd Benj.a Bishop by their attrys afd & ye afd Benj.a Bishop by his said attry Prays further Leave to Imparle hereunto untill the Next Court & he hath it and ye same Day is Given to ye afd Plft here also &c Att which said Next Court to witt ye seventeenth Day of March Anno Dom one thousand Seven Hundred & twenty Nine Came Again as well ye afd Francis Porter as ye afd Benj.a Bishop by their attry afd & ye afd Benj.a Bishop by his said attry as before (Defends) |
