249 Scarborough, Jn.o Dennis sen.r Jn.o White Annamessex Abraham Owtten Jn.o Murray, Aaron Linn Robert Mitchell & Benj.a Houston who being duely Elected tryed and Sworn to say the truth in the premisses upon their Oath do Say that the Said William Smith is Guilty of the Severall Trespasses as the afd James Lindow above against him hath Complained and they assessed the damages of the said James Lindow by Occasion of the trespasses afd by the afd William in form afd made to the value of ten shillings Curr.t money and for his Costs and Charges by him about his Suit in that part apposed to One pounds of tobo Therefore it is Considered that the afd James Lindow recover against the afd William Smith ten Shillings Curr.t money and One pounds of tobacco his damages afd by the Jurors afd in form afd assessed as also one hundred and twenty One pounds of tobacco for his Costs and Charges afd by the Court here to the Same James adjudged which Certain damages in the whole do amount to ten Shillings Currt mony and One hundred and Twenty two pounds of tob.o And the afd William Smith be taken &c
and Twenty Eight at Somersett County within the Jurisdiction of this Court was Indebted unto the same Joseph in the Sum of four pounds Curr.t money and two hundred and three pounds of tobacco and so thereof Being Indebted ye s.d Jn.o In Consideration thereof afterwards to witt ye same Day & Year afd at ye Co.ty afd within ye afd Jur upon Himselfe assumed & to ye same Jos: then & there faithfully did Promise that he when afterwards he Shou'd be thereto requested ye afd Sum of four Pounds & two hundred & three Pounds of tob.o to ye same Jos: he wou'd well & faithfully Content & Pay Nevertheless ye same Jn.o his Promise & assumption afd in form afd made Little regarding but Plotting & fraudulently Intending him ye s.d Jos in y.t part Craftilly & Subtilly to Defraud & Deceive he ye afd Sum of four Pounds & two hundred & three Pounds of tob.o Nor any Part thereof to the same Jos: hath not paid or him for it in Anywise Contented altho' ye s.d Jn.o ye same to Do afterwards to witt ye same Day & Year afd at ye Co.ty afd & within ye afd Jur by ye same Jos was thereto requested but he ye same to do hath altogether refused & Still Doth refuse whereby ye same Jos: say's he is worse & Hath Dam to ye value of Eight pd.s Like Mony & four Hundred & Six pds of tob.o & thereof he Brings this Suite &.a L Gale P Quer Pledges &.a J Doe R Roe And ye afd Jn.o Blizard by francis Allen His attry Comes & Defends the force and Injury when &.a And Prays Leave to Imparle hereunto untill the Next Court & he hath it & the Same Day is Given to ye afd Plft here also &a Att which said Next Court to witt the Eighteenth Day of Novem.r Ann.o Dom one thousand Seven hundred & twenty Nine Came Again as well ye afd Jos: as the afd Jn.o by their attrys afd & ye afd Jn.o by his ^said^ attry afd Prays further Leave to Imparle hereunto untill the Next Court & he hath it & ye same Day is Given to the afd Plft here also &a Att which said Next Court to witt ye seventeenth Day of March Ann.o Dom.r one thousand Seven hundred & twenty Nine Came Again as well the afd Joseph as ye (afd) |
