 Somersett ss.  William Smith late of somersett County Planter was attached to answer
unto James Lindow of a plea of trespass &c
And whereupon the said James Lindow by Levin Gale his attorney
       Complains that the said William Smith the twelfth day of November anno Dom One thousand Seven
       hundred and Twenty Eight with force & Arms the Close at the same James at Somrsett Co.ty
did Break & his Grass to the value of forty Shill.s Curr.t Mony there Late Growing
with Certain Beasts that is to say two Geldings Depastured trod Down & Consumed and
the fruit trees that is to say forty of his fruit trees there Late Growing with Certain
Beast that is to say two Geldings did Quite Spoil & also ye fifteenth day of Novem.r
then Next following with force & Arms ye Close of him ye s.d James ye s.d Will.m
did Break & his Corn that is to say his wheat to ye value of forty Shill.s then
& there Growing with Certain Beast that is to say two Geldings he did Eat up &
tread Down & Consume & Other Harms to ye s.d James then & there did doe to his
Great Damage & against ye Peace &.c  Whereby ye s.d James Say's he is worse and
hath Damage to the Value of twelve Pounds Curr.t Mony & thereof He Brings
this Suite &.a                              Levin Gale  P Quer Pledges &.a  J Doe R Roe

       And the afd W.m Smith by Francis Allen his attry Comes & Defends the force
& Injury when &.a  And Prays Leave to Imparle hereunto untill the Next Court
& he hath it & ye same Day is Given to ye afd Plft here also &c

             Att which said Next Court to witt ye Nineteenth Day of August Ann.o Dom one
thousand Seven Hundred & twenty Nine Came Again as well the afd James Lindow
as ye afd W.m Smith by their attrys afd & the afd William Smith by his attry afd prays
further Leave to Imparle hereunto untill the Next Co.t & he Hath & the same day
is Given to ye afd Plft here also &a

          Att which said Next Court to witt the Eighteenth Day of Novem.r Ann.o Dom one
thousand Seven Hundred & twenty Nine Came Again as well ye afd James Lindow
as ye afd W.m Smith by their attrys afd & ye afd & ye afd W.m Smith by his attry afd prays
further Leave to Imparle hereunto untill ye Next Co.t & he hath it & ye same
Day is Given to ye afd Plft here also &a

             Att which said Next Court to witt ye seventeenth Day of March Anno Dom.r
One thousand Seven Hundred & and twenty Nine Came Again as well ye afd James
Lindow as ye afd W.m Smith by their attrys afd & ye afd W.m Smith by his said
Attry as before Defends the force & Injury when &a                  And saith that
he if ye severall trespasses above upon him Imposed is not Guilty in Manner
& form as ye s.d Sher to witt Jn.o Purnell Gent Now Here at this day to witt ye
Same Day & Year Last Mentioned Comes & Makes return that he hath here ready
twelve &.a  As by his Said Precept he was Commanded And Now Here afterwards to witt
ye s.d same Day & Year Came as well ye afd James Lindow as ye afd W.m Smith by
their attrys afd & the Jurors of that Jury therein Impannelled Being Called Likewise
Came to witt W.m Handy, W.m Turpin Jun.r Geo: Benston Jos: Gray John
