248 Whereupon the afd Adam Clarke being Called appears and thereupon the said Adam Clarke at the prayer of the Plft by his attorney afd is Adjudged to give Speciall bail to the action afd but for want thereof the said Adam Clarke is Committed into the Custody of the Sher of Somersett County thereto remain &.c the Said sher to witt John Purnall Gent.m present here in Court took Charge of the Said Adam Clarke accordingly &.c Thereupon day is given unto the Said Adam Clarke in Custody as afd untill the Next Court and the SAme day is given to the afd plft here also &c Att which said next Court to witt the seventeenth day of June Anno Dom One thousand seven hundred and twenty Nine Came againe as well the afd Jonathan Fisher by his attorney afd as the afd Adam Clarke in Custody as afd by Levin Gale his attorney and thereupon further day is Given unto the afd Adam Clarke in Custody afd in the plea afd until the next Court and the same day is given to the afd Plft here also &c Att which said Next Court to witt the ninteenth day of August Anno Dom One thousand Seven hundred and twenty nine Came againe as well the afd Jonathan Fisher by his attorney afd as the afd Adam Clarke in Custody as afd by Levin Gale his attorney afd and thereupon further day is Given ^un^to the afd Adam Clarke in Custody as afd in the plea afd untill the next Court and the Same day is Given to the afd plft here also &c Att which said next Court to witt the Eighteenth day of November anno Dom One thousand Seven hundred and Twenty Nine Came againe as well the afd Jonathan Fisher by his attorney afd as the afd Adam Clarke in Custody as afd by his attorney afd And Thereupon further day is Given to the afd Adam Clarke in Custody as afd in the plea afd and the same day is Given to the afd Plft here also &c Att which said next Court to witt the seventeenth day of March anno Dom One thousand Seven hundred and twenty Nine Came againe as well the afd Jonathan Fisher by his attorney afd as the afd Adam Clarke in Custody as afd by attorney afd And whereupon the said Adam Clarke in Custody as afd by his said attorney defend the force and Injury when &c And Says that ye afd Jonathan Fisher his Action afd Against him ye Same Adam to Have & Maintain Ought Not Because he say's that well and true it is that he did assume in Manner & form as the Plantiff in his Declaration afd hath Complained but ye sd Adam further Saith yt after ye Makeing ye Promise & assumption afd Above Supposed to be Made that is to say ye twenty Eight Day of Novem.r Ann.o Dom.r Seventeen Hundred & twenty EIght he ye said Adam at Somrsett Co.ty afd Gave & Delivered & Passed to ye afd Fisher an Obligation for ye Paym.t of fifty one Pounds fifteen Shill.s Curr.t Mony at Pensilvania in full Satisfaction & Discharge of ye Promise & assumption afd of ye afd Adam which said Obligation ye s.d Fisher then & there in full Satisfaction of the Promise & assumption afd of ye afd Adam did take Accept & receive & this he is ready to verifie Wherefore he Prays Judgm.t if ye afd Fisher his Action afd thereof against him ye s.d Adam to have & Maintain Ought &a Levin Gale And whereupon the afd Jonathan Fisher his writt and declaration afd then and there against the afd Adam Clarke did not prosecute but Voluntarily Suffered his Suit to be discontinued &c Therefore it is Considered that the afd Jonathan Fisher take nothing by his writt and declaration afd but that he and his pledges of Prosecuting (to witt) John Doe and richard Roe be in Mercy and that the afd Adam Clarke goe thereof without day &c |
