by his attry afd & ye Sher of Somrsett County to whome the foregoing Writt was directed
Likewise Cometh & Maketh return thereof to ye Court here Endorsed viz.t
                               Cepi Corpus declaration delivered in time   P Jn.o Purnell sher

       Whereupon the afd Alexander MccCants in his Own proper person appears and thereupon the said Alex.d
       MccCants at the prayer of the afd Joseph MccClester by his attorney afd is adjudged to give speciall bail
       to the action afd but for want thereof the said Alex.d is Committed into the Custody of the sher of Somersett
    County thereto remain &.c  Whereupon the Said Sher to witt Jn.o Purnall by Jn.o Dennis Jun.r his under
    Sher ^present here in Court^ took Charge of the said Alexander accordingly &c

                                    And afterwards the afd Alexander MccCants in Custody as afd present here in Court in
    his proper person Comes and defends the force and Injury when &.c and Says that he Cannot Gainsay the
action afd of the afd Joseph nor but that he did assume upon himselfe in manner and form as the afd Joseph
above against him hath Complained and as to the damage of the Same Joseph by Occasion of the premisses in
that part Sustained the Same Alexander says and Confesseth that the afd Joseph hath Sustained Damage by
Occasion of the premisses beyound his Costs and Charges by him about his Suit in that part apposed to
Forty pounds Curr.t mony and not more and because the afd Joseph deny's not this but the Same
Allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs
and Charges afd to him ^to be^ adjudged &.c   Therefore by Consent of the parties afd it is Considered that the afd
Joseph MccClester Recover against the afd Alexander MccCants in Custody as afd his damages afd to forty pounds
Curr.t money by the Same Alexander in form afd Confessed as also three hundred and Sixty Nine pounds of
tobacco for his Costs and Charges aforesaid to the Same Joseph at his request by the Court here adjudged and by
Consent of the partyes afd adjudged which Certain Damages in the whole do amount to forty pounds Currt
money and three hundred and Sixty nine pounds of tobacco and the afd deft in mercy &c

             Whereupon the afd Alexander MccCants at the prayer of the afd Joseph MccClester by his attorney afd
is Committed into the Custody of the Sher of Somersett County thereto remain untill the afd Joseph of
his damages afd should be fully Satisifed whereupon the Said Sher to witt John Purnall Gent
by John Dennis Jun.r his under sher being present ^here in Court^ took Charge of the said Alexander accordingly &c

                 Memorand.m the Plft by Levin Gale his attorney sued out his
his Lordships writt of Scirefacias against the defendent the tenor
whereof followeth in these words vizt
Somersett ss   Charles absolute Lord and Proprietary of the provinces of Maryland and avalon
Lord Baron of Baltemore &.c  To the sher of Somersett County Greeting Whereas a Certain John
Dennis Jun.r late of somersett County Gent lately in Our County Court of Somersett here to witt; the seventeenth
day of June anno Dom One thousand Seven hundred and twenty nine before Samuel Hopkins
Gent and his associates then Our Justices at Dividing Creek in Our County afd assumed upon himselfe
and did undertake for a Certain Robert Gibbs late of somersett County Marriner that in Case a Certain
James Dickerson should recover Judgm.t against the afd Robert Gibbs in a Certain plea of trespass
upon the Case &.c by the same James against the afd Robert in Our same Court prosecuted or that ye
same Robert should be therein Convict that then the said Robert all the Damages which to the same
