    Therefore it is Considered by Consent of ye Parties afd that ye afd Jos MaClester
recover Against ye afd W.m Collins Eleven Hundred & thirty One pounds of tob.o his
his Damages afd by the same W.m Collins in form afd Confessed as also two hundred
234   and thirty four        pounds of tob.o for his Costs & Charges afd to ye same Jos
at his request by ye Court here & by Consent of ye Parties afd adjudged which Certain
Damages in ye Whole do Amount to Thirteen Hundred and Sixty five

     Command was Given to the sher of Somersett County that he should take Alexander
MaCants Late of Somrsett Co.ty Schoolmaster if he Should be found in
his Balywick & him should safe Keep so yt he Might have his body
before the Justices of his Lordships Coty Co.t of somrsett to be
                held at Dividing Creek ye third tuesday of March then Nextto answer unto
Jos: MaClester of a plea of trespass upon ye Case &.a  And that thereof he Should not
fail &.a  And ye afd Jos: MaClester by Levin Gale his attry Complained against ye said
Allexander MaCants in the plea afd as Followeth vizt

          Somrsett ss:   Allex.d MaCants Late of somrsett Co.ty Schoolmaster was
                   Attached to answer unto Jos: MaClester of a plea of trespass upon ye Case
                &a         And Whereupon ye same Jos: by Levin Gale his attry Complains
yt whereas ye afd Allex.d MaCants ye tenth day of Novem.r Seventeen Hundred
& twenty Eight at somrsett Co.ty within ye Jur of this Court was Indebted unto the
Same Jos MaClester in the Sum of thirty pounds Sterling for ye Like Sum
at his Especial Instance & request before that time for the said Allexander paid
& so thereof being Indebted ye said Allex.d in Consideration thereof afterwards to
witt ye same Day & Year afd at ye Co.ty afd & within ye afd Jur upon himselfe
assumed & to ye same Jos: then & there faithfully Promissed yt he ye said Allexand.r
when afterwards he Should thereunto be requested ye afd Sum of thirty pounds
Sterling unto ye same Jos: he wou'd well & faithfully Content & Pay Nevertheless
ye afd Allex.d his Promise & assumption afd in form afd Made Little regarding
but Plotting & fraudulently Intending him ye said Jos: in yt part Craftilly
& Subtilly to Defraud & deceive he ye afd sum of thirty pounds Sterling Nor
Any part thereof unto the Same Jos: Hath not Paid or him for it in anywise
Contented altho' ye said Allexander ye same to do afterwards to witt ye same day &
year afd at ye Co.ty afd within ye afd Jur was requested but ye said Allexander
ye same hitherto to do hath altogether refused & Still doth refuse whereby
ye same Jos: says he is worse & Hath Damage to the value of Forty five
Pounds Sterling & thereof he Brings this Suite &a
