unto Richard Poltney of a plea of trespass upon the Case &c
             And whereupon the Said Richard by Francis Allen his attorney Complaines
                            that Whereas ye said Jn.o the Eighth Day of August Ann.o Dom one thousand
    Seven Hundred & twenty Eight at somrsett Co.ty afd within ye Jur of this Court was Indebted
unto ye said Rich.d Seven pounds Eighteen Shill.s & Six pence Curr.t Mony as by Note by the
Said Jn.o Signed May appear & being so thereof Indebted ye said Jn.o in Consideration
thereof ye Day & Year afd at ye Co.ty afd upon himselfe did assume & to ye said Richard
then & there faithfully did promise that he ye said Jn.o ye said Seven pd.s Eighteen
Shill.s & Six pence Curr.t Mony or Bills of Creditt on or before ye Eighth day of October
then Next Ensuing to ye said Richard he would well & faithfully pay & Content Nevertheless
ye afd Jn.o his Promise & assumption afd in form afd Made Nothing regarding but
Plotting & fraudulently Intending ye said Rich.d in yt part Craftilly & Subtilly to deceive
& Defraud ye said Seven pd.s Eighteen Shill.s & Six pence Curr.t Mony or Bill of Creditt
to ye s.d Rich.d altho' ye same to do ye said Jn.o on ye afd Eight day of October in ye Year
afd & often afterwards at ye Co.ty afd by ye said Rich.d he was thereunto requested hath
Not paid or to him for ye same in any wise Contented but the Same to him hitherto to
pay or in Any Sort to Content hath refused & Still doth refuse & Deny Whereupon he
Saith he is worse & hath Damage to ye value of Sixteen pounds Curr.t Mony of
Maryland & whereupon he brings Suite &c      F: Allen P Quer Pledges &.a  J Doe  R Roe

          Whereupon ye said Jn.o Price in his own proper Person Comes & Defends the
force & Injury when &.a  And says that he Cannot Gainsay ye Action afd of ye afd Rich.d
nor but yt he did assume upon himselfe in Manner & form as ye afd Rich.d above
against him hath Complained & as to ye Dam of ye said Richard by him by Occasion
of ye premisses in yt part Sustained ye same Jn.o says & Confesseth that ye afd Rich.d
has Sustained Damage by Occasion of ye Premisses beyond his Costs & Charges
by him about his Suite in that part apposed to Seven pd.s Eighteen Shill.s &
Six pence Curr.t Mony & Not More & because ye afd Richard deny's not this but the
Same Alligation Confesseth to be true Pray's Judgm.t & those Damages above Confessed
together with his Costs & Charges afd to him adjudged &c

            Therefore it is Considered by Consent of ye Parties afd yt ye afd Rich.d
    Poltney recover against ye afd Jn.o Price Seven pounds Eighteen Shill.s & Six
pence Curr.t Mony his Damages afd by ye same Jn.o in form afd Confessed as also
210   Two hundred & ten        pounds of tob.o for his Costs & Charges afd to ye same
Richard at his request by ye Court here & by Consent of ye Parties afd adjudged
which Certain Damages in ye whole do Amount to Seven pd.s Eighteen Shill.s &
