Whereupon ye said Jn.o Smith being Called appears & thereupon the Said Jn.o Smith at ye prayer of ye said Allex.d Draper by Francis Allen his attry is adjudged to Give Special Bail to ye Action afd Thereupon a Certain W.m Gray of somrsett Co.ty Planter Present here in Co.t in his Proper Person undertakes for the Said Jn.o Smith that if in Case ye said Allex.d Draper Shall recover Judgm.t in ye Plea afd against ye said Jn.o Smith or yt ye said John Smith Should be therein Convict that then he ye said Jn.o Smith Shall Pay the Condemnation of the Co.t thereupon or render his Body to ye Custody of ye Sher of Somrsett Co.ty in Satisfaction thereof or y.t he ye said W.m Gray will do it for him &a Whereupon ye said Jn.o Smith in his own proper person appears Appears & Imparles till Next Court &a
Christopher in three hundred Seventy three pounds of tob.o and twenty two Shill.s Curr.t Mony for Sundry Goods wares & Merchandizes by ye said Christopher to ye said John at ye Special Instance & request of ye said Jn.o Before that time there Sold & Delivered & being so thereof Indebted ye Said Jn.o Bishop in Consideration thereof the day & year afd at the Co.ty afd upon himselfe did assume & to the Said Christopher then & there faithfully did promise that he the said Jn.o ye said three hundred seventy three pd.s of tobo & twenty two Shills Curr.t Mony to ye said Christopher when thereunto afterwards he Should be requested he would well & faithfully pay & Content Nevertheless ye afd Jn.o Bishop his Promise & assumption afd in form afd Made Nothing regarding but Plotting & fraudulently Intending ye said Christopher in that Part Craftilly & Subtilly to deceive & defraud ye said three hundred Seventy three pd.s of tob.o & twenty two Shill.s Curr.t Mony to ye said Christopher altho' ye same to do the Said Jn.o Bishop on ye afd first day of Novem.r in the Year afd and often afterwards at ye Co.ty afd by ye said Christopher he was thereunto requested hath Not paid or to him for the Same in anywise Contented but the Same to him hitherto to Pay or in any sort to Content hath refused & Still doth refuse & Deny Whereupon he saith he is worse & hath Damage to ye value of five pounds Curr.t Mony of Maryland & thereupon he Brings Suite &a F: Allen P Quer Pledges &.a J Doe R Roe Whereupon ye said Jn.o Bishop by George Dashiell his attry Comes and Defends ye force and Injury when &.a And says ^that^ he Cannot Gainsay ye Action afd of ye afd Christopher Nor but that he did assume upon himselfe in Manner & form as ye afd Christopher above against him hath Complained & as to ye Damage of ye said Christopher by him by Occasion of the Premisses in that part sustained the same Jn.o Says & Confesseth y.t the afd Christopher has Sustained Damage by Occasion of ye Premisses beyond his Costs & Charges by him about his Suite in that part apposed to three Hundred Seventy three pounds of tob.o & twenty two Shill.s Curr.t Mony & Not More & because ye afd Christopher deny's not this but ye Same Alligation Confesseth to be true Prays Judgm.t & those Damages above Confessed together with his Costs & Charges afd to him adjudged &.c Therefore it is Considered by Consent of the Parties afd that the afd Christopher Glass recover against ye afd Jn.o Bishop three Hundred Seventy three pd.s of tob.o and (twenty) |
