1729 231 Whereupon the said Catherine Dial present here in Court in her proper person is at the prayer of the afd Thomas Walker by his attorney afd Committed into the Custody of the Sher of Somersett County thereto remain untill the afd Thomas of his damages afd should be thereof fully satisfied Thereupon the afd John Purnall sher being present herein court took Charge of the said Catherine accordingly &c Ordered by the Court that John Hambleton Pay a Cause to be paid unto William Mister Sixty pounds of tobacco it being due unto him for his attendance as an Evidence ^two days^ for her Son His Lordship the Lord Proprietary against him he having made Oath to the same &c Ordered by the Court that John Tilman Pay or Cause to be paid unto William furnis One hundred and Eighty pounds of tobacco it being due unto him for his and wifes attendance three days each for the said John Tilman as Evidence against Margt Wailes they having made Oath to the Same &c Ordered by the Court that Marg.t Waile pay or Cause to be paid unto Bridgett Phillips One hundred and twenty pounds of tobacco it being due unto her for her attendance four days as Evidence on behalfe of said Margt Waile ag.t John Tilman she having made oath to the Same &c Ordered by the Court that Margt Waile pay or Cause to be paid unto W.m Jones Back Creek two hundred and forty pounds of tobacco being due unto him for his attendance Eight days as an Evidence for the Said Marg.t Waile against John Tilman he having made oath to the Same &c Ordered by the Court that John Tilman pay or Cause to be paid unto Robert King One hundred and fifty pounds of tobacco being due unto him for his attendance five days as Evidence for the said John Tilman against Margt Waile he having made Oath to the same &c
that whereas the afd Jn.o Bishop ye tenth day of Novem.r one thousand Seven Hundred & twenty Eight at somrsett Co.ty within ye Jur of this Co.t was Indebted unto the same Jn.o Tonstall in ye sum of two pounds ten Shill.s Curr.t mony for a pair of Milstones to ye s.d Bishop before that time by ye s.d Tonstall at his Especiall Instance & request sold & Delivered & so thereof being Indebted ye said Jn.o Bishop in Consideration thereof afterwards to witt ye same day & year afd at ye Co.ty afd & within ye afd Jur upon himselfe assumed & to the same Jn.o Tonstall then & there faithfully did Promise that he when afterwards he Shou'd be thereto requested he ye afd Sum of two pounds Ten Shill.s Curr.t ^mony^ to ye same Tonstall he wou'd well & faithfully Content & Pay Nevertheless ye Said Jn.o Bishop his Promise & assumption afd in form afd Made Little regarding But Plotting & Fraudulently Intending him ye same Jn.o Tonstall in yt part Craftilly and Subtilly to Defraud & Deceive he ye afd Sum of two pd.s ten shills Curr.t Mony nor any part thereof to ye same Jn.o Tonstall hath ^not^ paid altho ye said Bishop the Same to do afterwards to witt ye same day & Year afd at ye Co.ty afd within ye afd Jur by the Same Jn.o Tonstall was thereto requested (but) |
