November Court 1729 232 But the said Bishop the Same hitherto to do hath altogether refused & the Said Bishop the Same to do Still doth refuse Whereby the Same John Tonstall Say's he is worse & hath Damage to the value of two pounds Ten Shills and thereof he Brings this Suite &a Levin Gale P Quer Pledges &.c J Doe Rich.d Roe And the afd Jn.o Bishop by Francis Allen his attry Comes & Defends ye force and Injury when &.a And Prays Leave to Imparle hereunto untill the Next Co.t And he hath it and & the Same day is Given to ye afd Plft here also &a Att which said Next Court to witt the Eighteenth day of November anno Dom one thousand seven hundred and twenty Nine Came again as well the afd John Tunstall as the afd John Bishop by their attorneys afd and whereupon the afd John Bishop says that he Cannot gainsay the action afd of the afd John Tunstall nor but that he did assume upon himselfe in manner and form as the afd John Tunstall above against him Complained and as to the damage of the same John Tunstall by him by Occasion of the premises if that part sustained the said John Bishop saith and confesseth that the afd John Tunstall sustained damage by occasion of the premises beyond his Costs and Charges by him about his Suit in that part apposed to two pounds ten Shillings Currant money and not more and becaus the afd John Tunstall denys not this but the same allegation Confesseth to be true prays Judgmt and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the Parties afd it is Considered that the afd John Tunstall recover against the afd John Bishop his damages afd to two pounds tenn shillings Curr.t money by the same 215 John Bishop in form afd Confesed as also Two hundred & fifteen pounds of tobo for his Costs and Charges afd to the same John Tunstall at his request by the Court here and of the Consent of the parties afd adjudged which Certain Damages in the whole do amount to two pounds ten Shillings Curr.t mony and pounds of tobacco and ye afd deft in mercy &c
The above Executions were Returned Cepi Corpus to November Court ann.o 1729
The severall writts belonging to the Severall actions above were returned Cepi Corpus by the sher of somersett County to Novem Court anno 1729 And Entered agreed ye same Court |
