230 he is not Guilty of the premisses above upon him Imposed in manner and form as the plft against him hath complained ^and^ of this he puts himselfe upon the Country and the plft in like manner Thereupon Command is given to the Sher of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c becaus as well &.c of which said preceipt the said sher to witt John Purnall Gent now hereat this day to witt the same day and year Last mentioned makes return that he hath here ready twelve &.c as by his said preceipt he was Commanded and now hereafterwards to witt the same day and year Year Came as well the afd plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called ^likewise^ Came to witt John Scarbrough, Jon.a Sturges John Brittingham, Thomas Holbrook, Cannon Winwright, Edward Jones, Isaiah Bredall, John Pope, Crispin Price, William Mills, Jno Webb, Wm Gray who being duely Elected tryed and Sworn to say the truth in the premisses upon their Oath do say that the afd John Tilman is not Guilty of the trover and Conversion as the afd Margrett Waile above against him hath Complained &c Therefore it is Considered that the afd Margt Waile take nothing by her writt and declaration afd but be in mercy for her falce Clamour and that the afd John Tilman goe thereof without day and further it is Considered by the Court here that the afd John Tilman Recover against the afd Margt Waile One thousand and 1070 Seventy pounds of tobacco for his Costs and Charges by him about his defence in that part Expended to the same John by the Court here According to the form of the Statute thereof lately made and provided adjudged and that the same John have thereof Execution &c
Charity Tully, John Tully and Alexander Tully their heirs Ex.rs adm.rs or assigns to the which payment well and truely to be made and done we bind Our selves Our and Either of Our Heirs Exrs and adm.rs for the whole and in the whole Joyntly and severally firmly by these presents sealed with our seal and dated this 19.th day of Novem anno Dom 1729 The Condition of the above Obligation is such that whereas the Commissary Gen.ll hath transmitted into this Court the accompt of the Estate of Edward Tully dec.d wherein it is found that there is ballance due to the abovesaid Orphans the sum of thirty two pounds one shilling and nine pence It Therefore the abovesaid Crisbin Price Robert Hardy & Thomas Holbrook or any or either of them or any or Either of their heirs Executors or adm.rs do and Shall well and truly pay or Cause to be paid unto the afd Orphans the afd Sum of thirty two pounds One shilling and nine pence in Equall parts or portions when they shall attain to full age to receive the same according to act of assembly in such Case made and provided &.c then the above Obligation to be void & of none Effect otherwise to remain in full force and vertue his Sealed and delivered in presence of Chrisbin C Price (seal) John Handy marke James Dashiell Robert Hardy (seal) Tho.s Holbrook (seal) |
