227 Whereupon the said Charles Croson at the prayer of the afd Ann Cox by francis Allen her attorney is adjudged to give Speciall bail to the Action afd Thereupon a Certain John Donelson of somersett County Gent.m present here in Court undertakes for the said Charles Croson that if in Case the afd Anne Case shall recover Judgm.t in the plea afd against the said Charles Croson or that the said Charles Croson shall be therein Convict that then he the said Charles Croson shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somersett County in satisfaction thereof or that he the said John Donelson will do it for him Thereupon the said Charles Crosen by Levin Gale his attorney appears & Imparles till next Court &c
Creek the third tuesday of November then next to answer unto John Caldwell of a plea of trespass upon the Case &c and that thereof he should not fail &c And whereupon the same John by Levin Gale his attorney Complains that whereas the afd Joseph the tenth day of November ann.o Dom One thousand seven hundred and twenty Eight at somersett county within the Jurisdiction of this Court was Indebted unto the Same John in the sum of forty five shillings Currant money for divers goods at his especiall ^Instance^ request by the said John before that time sold and delivered him and so thereof being Indebted the said Joseph in Consideration thereof afterwards to witt the same day and year afd at the County afd and within the afd Jurisdiction upon himselfe assumed and to the same John then and there faithfully did promise that he when afterwards he should be thereunto requested he the afd Sum of forty five shillings Currant mony to the Same John he would well and faithfully Content and pay nevertheless the said Joseph his promise & Assumption afd in form afd made Little regarding butt plotting and fraudulently Intending the same John in that part Craftilly and subtilly to deceive and defraud he the afd sum of forty five shillings nor any part thereof to the same John hath not paid altho' the said Joseph the Same to do afterwards to witt the same day and year afd at the County afd was requested by the same John but the said Joseph the same hitherto to pay or the same John for it in anywise to Content hath altogether refused and the said Joseph the Same to do still doth refuse whereby the Same John says he is worse and hath damage to the Value of four pounds & thereof he brings this suite &.c L Gale Qer pledges &c Jno Doe R Roe Att which said third tuesday of November to witt the Eighteenth day of the Same Month anno Dom Dom One thousand seven hundred and twenty Nine being the day of the return of the said Writt Comes the afd John Caldwell by his attorney afd and the sher of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof Endorsed in these words following viz.t Non est Inventus P John Purnall sher Whereupon the said John Caldwell by his attorney afd prays that for as much as he has Complyed with the law in order to an attachment he may have Judgm.t against the said Joseph Holder for his damages |
