damages afd by way of attachment according to act of assembly &.c   Whereupon for that it seems to the
Court here that the afd John Caldwell has Complyed with the law as alledged

                Therefore it is Considered by the Justices here that the afd John Caldwell recover against the
afd Joseph Holder as well the sum of forty five shillings Currant mony his damages by Occasion of
the premises afd as all Costs and Charges by the said plft laid out and Expended about his suit by way
196   of attachm.t against the goods Chattells rights or Creditts of the said Joseph Holder according to act of
assembly in such Case made and provided &c

     Command was given to the sher of somersett County that he should
          take Joseph Holder Late of Somersett County planter if he shall be
found in his bailywick and him should safe Keep so that he might have his
body before the Justices of his Lordships County Court of somersett to be held at Dividing Creek the third
tuesday of November then next to answer unto Betty Gale of a plea of trespass upon the Case &.c and
that thereof he should not fail &c
                                                                         And whereupon the same Betty by Levin Gale his attorney
Complains that whereas the afd Joseph the tenth day of Novem anno Dom One thousand Seven hundred
and twenty Eight at somersett County within the Jurisdiction of this Court was Indebted unto the Same
Betty in the sum of three pounds Curr.t mony of maryland and thereof being Indebted the said Joseph
in consideration thereof afterwards viz.t  the same day and year afd at the County afd and within the
afd Jurisdiction upon himselfe assumed and to the same Betty then and there faithfully promised that
he when afterwards he should be thereto required he the afd Sum of three pounds Curr.t money to the
same Betty he would well and faithfully Content and pay   Nevertheless the said Joseph his promise
and assumption afd in form afd made not regarding but plotting and fraudulently Intending
her the same Betty in that part Craftilly and Subtilly to deceive and defraud the afd three pounds Curr.t
mony or any part thereof ^to^ the Same Betty he hath not paid altho' the same to do the afd Joseph
afterwards viz.t the same day and year afd at the County afd and within the afd Jurisdiction by the
same Betty was requested but he the same hitherto to do hath altogether ^re^fused and still doth refuse
whereby the same Betty says she is worse and hath damage to the Value of Six pounds Like mony
and thereof she brings this Suite &.c                  L Gale P Quer   Pledges &.c  Jno Doe  R Roe

               Att which said third tuesday of November to witt the Eighteenth day of the same month anno
Dom One thousand seven hundred and twenty nine being the day of the return of the said Writt Cometh
the said Betty Gale by her attorney afd and the sher of somersett County to whom the foregoeing writt was
directed ^likewise^ Cometh and maketh return thereof to the Court here Endorsed viz.t non est Inventus P Jno Purnall sher

    Whereupon the said Betty Gale by her attorney afd prays that for as much as she has Complyed
with the Laws in order to an attachment she may have Judgmt against the said Joseph Holder for her
                                                                                                                                        damages
