225 by whiping of the afd John Hambleton at the publick whiping post with ten Lashes ^on ye Bear Back^ well Laid on untill the blood appear and by seting him in the pillowry a quarter of an hour &.c and afterwards in the same Court the said sher returned that he had done the Execution of the Judgmt afd afd as to the Corporall punishment afd he was Commanded &.c Thereupon the Sad Jno Hambleton is Committed into ye Custody of the sher of Somersett county thereto remain untill delivered from thence by due Course of Law &c And forasmuch as the afd John Hambleton hath not wherewithall to Satisfie the four fould on the two Severall Indictments and all the Officers their fees due by occasion of the premisses Whereupon it is ordered by the Court that the sher of Somersett County sell the afd John Hambleton to the biggest bidder according to Law to Satisfie the four foulds afd and all the Officers their fees due by Occasion of the premisses afd &.c Ephraim Willson, Samuel Willson, Joseph Thompson, William Thompson, and William Misters appears according to their Recognizance to give Evidence against Jno Hambleton and are discharged &c John Philips appears according to his Recognizance for good behaviour and is discharged therefrom
thousand Seven hundred and twenty nine with force and armes in and upon a Certain Eliz.a Ward in the peace of God &.c being did make an assault and affray and her the same Eliza Ward then and there did beat wound and evill Intreat so that of her life it was despaired and Other harms to her did to the great damage of the same Eliz.a Ward and against the peace of the said Lord prory Dashiell prosecutor Pr Ld Pry Testis Eliz.a Ward On the backside of the foregoeing Bill of Indictm.t it was thus Endorsed viz.t Billa vera Edward Rownd foreman Thereupon Command was Given to the sher of Somersett County that he should take the said John Sheldon if &c to answer &.c and afterwards in the Same Court Came the said John Sheldon in his own proper person and being sett to the bar and the Indictment being unto him Read is thereupon Instantly demanded how he would acquitt himselfe of the trespass and assault above upon him Imposed says that of the trespass and assault afd he is Guilty thereof and putts himselfe upon the favour of the Court Wherefore it is Considered by the Justices here that the said John sheldon be taken to satisfie his said Lordship of his fine by occasion of the trespass and assault afd which said Jno Sheldon present here in court afd prays he may be admitted at fine with his said Lordship by occasion afd and thereof he putts himselfe in mercy of his said Lordship & ye fine of ye said Jno sheldon is by the Court assessed to one hundred pds of tobo to the use of his said Lordship ye Lord propry &c |
