1729 224 the whole to four hundred pounds of tobacco (the afd goods being valued according to law) and that the afd John Hambleton be whipt with ten Lashes on the bear back well laid on untill the blood appear and that he stand in the Pillowry a quarter of an hour and that he be taken &.c and thereupon as tot he Corporall punishment afd Command is Given to the sher of Somersett County that he do thereof Immediate Execution according to the Judgmt afd rendered by whiping the afd John Hambleton at the publick whiping post with ten Lashes on the bare back well laid on untill the blood appear and by setting him in the pillowry a quarter of an hour and afterwards in the same Court the sher Returns that he hath done the Execution of the Judgmt afd as to the Corporall punishmt afd he was Commanded &.c Whereupon the said John Hambleton is Committed into the Custody of the sher of Somrsett County thereto remaine till delivered from thence by due Course of Law &c
parish in somersett County afd Planter the tenth day of September anno Dom One thousand Seven hundred and twenty nine at Stepney parish and County afd within the Jurisdiction of this Court with force and armes one Corded fustin Vest and Britches of the value of two hundred pounds of tobacco one holland Shirt of the value of One hundred pounds of tobacco of the proper goods and Chattells of a Certain Samuel Willson then & there being and found then and there feloniously did take steal and Carry away against the peace of of the right honrble the Lord Proprietary of this province his good rule and Government and against the form of the act of assembly of this province in such Cases provided &.c Dashiell Psecutor for LPy Test Ephraim Willson, Jos Thompson, Allex.d Clarke William Mister On the back side of the foregoeing Bill of Indictment it was thus Endorsed viz.t Billavera Edward Rownd foreman Thereupon Command was given to the sher of Somersett County that he should take the said John Hamilton if &c to answer &c and Now hereafterwards to witt the Eighteenth day of November one thousand seven hundred and twenty Nine Came hereinto Court the said John Hamilton in his proper person in Custody of the Sher of Somersett County and being by the Sher sett to the bar Indictment Read is thereupon Instantly demanded how he would acquitt himselfe of the felony afd above upon him Imposed says that of the felony afd above upon him Imposed he is guilty thereof &c Whereupon the Justices here according to law valued the goods in the Indictm.t afd mentioned to be stolen to three hundred pounds of tobacco wherefore it is Considered by the Justices here that the afd John Hamilton pay unto the said Samuel Willson the party deprived four fold of the value of the goods afd amounting to twelve hundred ^pounds of tobo^ and that the afd John Hambleton be whipt at the publick whiping post with ten lashes on the bare Back well laid on untill the blood appear and that he stand in the pillowry a quarter of an hour and that he be taken &.c and thereupon as to the Corporall punishment afd Command is given to the sher of Somersett County that he do thereof Immediate Execution acording to the Judgmt afd rendered by |
