22 afd whereupon the afd Patrick Kersie by his said attorney as before defends the force and Injury when &.c And says that he is not guilty of the Premisses above upon him Imposed in manner and form as the Plft hath against him Complained and of this he putts himselfe upon the country &c And the afd Patrick Kersie by his attorney afd prays that the afd plft may Reply to the plea of the same Deft whereupon It is said to the same William by the Court here that he reply to the afd plea but afterwards the same William altho' Solemnly Called Came not nor to the plea of the afd Patrick Replieth nor is his declaration against the same William further prosecuted &c Therefore it is Considered by the Court here that the afd William Lingoe take nothing by his declaration afd but that he and his pledges of prosecuting that is John Doe and Richard Roe be in Mercy and that the same Patrick Kersie goe thereof without day &c And further it is Considered that the afd Patrick Kersie recover against the afd W.m 229 Lingoe Two hundred & Twenty Nine pounds of tobacco for his Costs and Charges by him about his defence afd in that part sustained Expended to the Same patrick by the Court adj according to the form of the statute in such manner of Case thereof Lately made and provided adjudged and that ye same deft have thereof Execution &c
Dom one thousand seven hundred & twenty six at ye Co.ty of Sussex upon Delaware viz.t at Somrsett Co.ty afd within ye Jur of this Court accounted together for divers Sums of Mony By the afd Abraham to ye said W.m before yt time due oweing and unpaid & upon that accounting the said Abraham was found in arere to ye same W.m Sixteen p.ds Eighteen Shills & two pence Lawfull Money of America & being thereof so Indebted the said Abraham in Consideration thereof upon himselfe did assume to ye said W.m then & there did faithfully Promise yt he ye said Abraham woud well & truly Content ^&^ pay ye afd sixteen p.ds Eighteen Shills & two pence to ye s.d W.m when he shou'd be thereunto afterwards required & altho' ye afd Abraham ten pds Pcell of the afd sixteen p.ds Eighteen Shill.s and two pence to ye afd W.m he hath paid and Satisfied Yet as to Six p.ds Eighteen Shills & two pence to ye afd W.m Due made Nothing regarding but Plotting and Fraudulently Intending the said W.m in yt part Craftilly & Cuningly to deceive & Defraud ye afd Six p.ds Eighteen Shill.s & two pence or any part thereof to ye s.d W.m hath not paid altho' ye same to do by ye said W.m afterwards (to witt) ye tenth day of August in ye year afd at Sussex afd & Divers other times before & since he was thereunto required but ye same to him to pay hither to hath denyed & still doth deny to ye Dam of him ye s.d W.m thirteen pds sixteen Shills & four pence & thereupon he Brings this Suite &.a & brings hereinto Court the acc.t Setled &c Jos: P: p Quer Pledges Psor Jno Doe Rich.d Roe |
