1727 22 And the afd Abraham Ingram by Levin Gale his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given unto the afd Plft here also Att which said next Court to witt the twenty first day of march ann.o Dom One thousand seven hundred and twenty six Came again as well the afd Plft as the afd Deft by their attorneys afd and thereupon said Abraham Ingram by his said attorney thereupon prayed further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also &c Att which said next Court to witt the Twentieth day of June Anno Dom One thousand Seven hundred & twenty seven Came again as well the afd Plft as the afd Deft by their attorneys afd and the afd Deft ^by his said attorney^ thereupon prayed further LEave to Imparle hereunto untill the next Court and he hath it and the same day is given unto the afd plft here also &c Att which said next Court to witt the fifteenth day of august ann.o Dom one thousand seven hundred and twenty seven Came againe as well the afd Plft as the afd Deft by their attorneys afd and the afd ^Deft^ by his said attorney as before defends the force & Injury when &c and says that he did not assume upon himselfe in manner and form as the plft against him hath Complained and of this he putts himselfe upon the Country &c and the afd Plft in Like manner Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c becaus as well &.c of which said Preceipt the said Sherr to witt Francis Allen Gent Now hereat to witt the fifteenth day of august Anno Dom One thousand seven hundred and twenty seven afd makes Return that he hath here ready twelve &c as by his said precipt he was Commanded and now here afterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being called Likewise Came to witt William Lane, Edw.d Jones, Richard Holland, John Pope, Thomas Carey John Townsend Jun.r Nathan.l Horsey, John Holland, James Thompson, Christopher Glass, W.m Francis, Robert Collier who being duely elected tryed and sworn ^to say ye truth in the premisses^ upon their Oath do Say that the afd Abraham did not assume upon himselfe in manner and form as the afd William above against him hath Complained &c Therefore it is Considered by the Court here that the Afd William Till take nothing by his declaration afd but be in mercy for his falce Clamour and that the afd Abraham Ingram goe thereof without day and further it is Considered that the afd Abraham recover against the afd William the sum of five hundred and forty 618 pounds of tobacco for his Costs and Charges by him about his suite in that part 540 Expended to the same Abraham of his assent by the Court ^here^ According to the form of the statute in such Case Lately made and provided adjudged &c |
