    Pounds Curr.t Mony for the Like Sum for his use before that time at his request by
the Said Jos paid & so thereof being Indebted ye said Andrew In Consideration thereof
after wards to Witt the Same Day & Year afd at ye Co.ty afd & within ye afd Jur
upon himselfe assumed & to the same Jos then & there faithfully Promised that
he ye s.d Tenn pounds when afterwards he Shou'd thereunto be requested ye afd
Sum of tenn Pounds unto the Same Jos he wou'd Well & faithfully Content and
Pay  Nevertheless ye afd Andrew his Promise & assumption afd in form afd made
Little regarding but Plotting & Fraudulently Intending him ye s.d Jos in that part
Craftilly & Subtilly to Defraud & Deceive he ye afd Sum of Tenn pounds
Nor any Part thereof unto ye same Jos: Hath not Paid or him for it in any
wise Contented Altho' ye s.d Andrew ye same to do afterwards to witt ye same Day & year
afd at ye Co.ty afd within ye afd Jur was thereto requested but ye s.d Andrew ye same
hitherto to doe hath altogether refused & Still doth refuse Who by ye same Jos
Say's he is worse and hath Damage to ye value of twenty Pounds Like Mony &
thereof he brings this Suite &.c         L Gale P Quer Pledges &.c  J Doe Rich.d Roe

             Att which said third tuesday of ^August^ June anno to witt ye s.d Eighteenth ^Ninteenth^ day of ye same
Month Ann.o ^Dom^ One thousand Seven Hundred & twenty Nine being the Day of the return of
the ^said^ Writt Cometh the said Jos: MaClester by his attry afd  And the Sher of Somrsett Co.ty to
Whom the foregoing Writt was Directed Likewise Cometh & Maketh return thereof
to ye Co.t here Endorsed viz.t Nonest Inventus Short note Left P.r John Purnall sher

          Whereupon ye s.d Jos: MaClester by his attry afd Prays that for as Much
as he has Complied with ye Law in order for to an attachment according
to Act of Assembly &.c   Whereupon for that it Seems to ye Co.t here that the
Said Jos MaClester has Complied with ye Law as alledged

                Therefore it is Considered by the Justices here that ye afd Joseph
MaClester Recover against the afd Andrew Scott as well the Sum of Tenn pd.s
78   Curr.t Mony his Damages afd also all Costs & Charges by the said Plft Laid Out
and Expended about his Suite by Way of Attachm.t against the Goods Chattles
rights or Creditts of the Said Andrew Scott According to act of assembly in
Such Case Made and Provided &c




                                  The         Court      Adjourns   untill the third tuesday of
