216 first Haveing Taken your Oath on ye Holy Evangelist of almighty God according to Act of assembly in Such Case Made & provided) & there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you Nominated by ye said Complaniant (or Deft if any) & yt you Examine them upon there Corporall Oaths to be by you or any three or two of you Administred on ye Holy Evangelist of ALmighty God in ye presents of ye Complanient (or Deft if any) touching the truth or remembrances of there Knowledge or any thing that May relate to ye Cause afd & yt reduceing the Severall Depositions into Writing you Send ye Same together with this our Commission under your or any three or two of your Hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Saml Hopkins Gent Chief Justice of our Said Co.t &c On ye Backside of ye foregoeing Commission it was thus Endorsed vizt Septem.r 7.th 1728 Came the within Mentioned Cap.t Edw.d North & Mr Jos: Wailes & was Sworn on the Holy Evangelist of Almighty God to Execute ye within Commission According to Act of assembly Before Me Jn.o Handy Wee ye Subscribers have Executed ye within Commission According to our Knowledge & ye Depositions Partinent thereunto have hereunto Annexed As Wittness Our Hands Edward North Jos: Wailes The Deposition of Rob.t Trueman aged Sixty ^Eight^ years or thereabouts Sayeth that he ye said Deponant Knew this tree viz.t a pine tree Meaning about forty years agoe then Liveing & the Marks in it plain to be Seen & by all then allowed to be the Second Bounder of Horseys Balywick & that Rich.d Jarrett allowed ye Said tree to be ye Second Bounder of Horsey's Balywick also & that he Lived Quietly & peaceably by ye said Jarrett Eighteen Years on ye tract of Land Called Little Beleau & further Saith not September the 15.th 1728 Taken by us Edw.d North The Deposition of Capt Jos: Venables aged Sixty years Jos: Wales or there about Sayeth that he ye Deponant Knew this tree this pine tree viz.t Standing upon ye South side of Wiccocomoco River upon a point Between two Marshes on the Southside of a Small Gutt Between ye Now Dwelling Plantations of Thomas Collier & Tho.s Bashaw to be allowed & Deemed & by all persons taken & allowed to be a bounder of a tract of Land Called Little Beleau & further Saith Not September the 15.th 1728 Taken by us Edw.d North The Deposition of Tho.s Bashaw aged forty Eight years Jos: Wailes or there abouts Saith that he ye Deponant a Considerable time ago was by Rich.d Phillips Informed that this pine tree Standing on ye South side of Wiccocomoco River upon a point of Land Runing Down Between Marshes on ye South side of (a Small) |
