216 A small gutt between between the plantations of Thomas Collier and Thomas Bashaw was the Second bounder of the tract of Land Called Little Belleau and that then the marks in the said tree was plain to be seen and further saith not Taken before us Edward North September ye 15th 1728 Jos: Wailes
Somersett County Court the said Sum of twenty pounds fifteen shillings and five pence to be Levied of your Bodys goods or Chattells Lands or tenements for the use of the said Charles Markland in Case the Said John Hendry shall not pay and Satisfie to the Said Charles Markland the said Sum of Twenty pounds fifteen Shillings and five pence so as afd recovered against him with the additional Costs thereon in the tenth day of February next Wm Planner Taken before us this 17 day of July anno Dom 1729 Jno Scott
the said Will.m ye twenty Ninth Day of March Ann.o Dom Seventeen Hundred & twenty Nine at Somrsett Co.ty afd within ye Jur of this Co.t was Indebted unto ye S.d Rich.d in Eleven pd.s twelve Shill.s & Eight Pence Curr.t Mony of Maryland as by Note hereunto Annexed may on Co.t appear & being so thereof Indebted ye s.d W.m in Consideration thereof the day & year afd at ye Co.ty afd upon himselfe did assume & to ye said Rich.d then & there faithfully did promise y.t he ye s.d Will.m ye s.d Eleven pd.s twelve Shill.s & Eight pence to ye s.d Rich.d when thereunto afterwards he Should be requested he wou'd well & faithfully pay & Content Nevertheless ye afd W.m his promise & assumption afd in form afd made Nothing regarding but Plotting & fraudulently Intending ye said Rich.d in y.t part Craftilly & Subtilly to Deceive & Defraud ye s.d Eleven pd.s twelve Shill.s & Eight pence to ye afd Rich.d altho ye same to do ye Said W.m on ye first Day of aprill in ye year afd & often afterwards at ye Co.ty afd but ye said Rich.d he was thereunto requested hath not paid or to him for the same in any wise Contented but ye same to him hitherto to pay or in any sort to Content hath refused & Still doth refuse & Deny Whereupon he Saith he is worse & hath Dam to the value of twenty pd.s Mony afd And thereupon he Brings Suite &c Fran Allen P Quer Pledges &c J Doe Rich.d Roe And the afd W.m Whale in his own Proper person Comes & Defends the force & Injury when &c and say's that he Cannot gainsay Say the action afd of the afd Rich.d nor but that he did assume upon himselfe in Manner & form as ye afd Richard above against him hath Complained & as to the Damage of ye Same Rich.d by him by Occasion of ye premisses in yt part Sustained ye Same W.m Say's & Confesseth that ye afd Rich.d has Sustained Damage by Occasion of ye premisses beyond his Costs & Charges by him about his Suit in yt part Expended to Eleven pounds twelve Shills & Eight Pence Curr.t Mony & Not More & because the afd Rich.d Denys not (this) |
