210 Impannelled being Called Likewise Came to witt Thomas Laws, Francis Lancake, John Onorton, James Jones John Townsend Jun.r Nehemiah Holland, John Webb, John Huet Nutter, Robert Walker, Samuel Taylor Samuel Hopkins Jun.r John Shockley who being duely Elected tryed and Sworn to say the truth in the premises upon their oath do say that the afd Thomas Hearn did not assume upon himselfe in Manner and form as the afd Ebenezer and Benjamin Handy above against him have Complained &c Therefore it is Considered that the afd Ebenezer and Benj.a Handy take nothing by their writt and declaration afd but be in Mercy for their falce Clamour and that the afd Thomas Hearn goe thereof without day &c and further it is Considered that the afd Thomas Hearn Recover against the afd Ebenezer and Benja Handy's 932 Three hundred & thirty Two pounds of tob.o for his Costs and Charges by him about his defence in that part Expended to the same Thomas Hearn by the Court here of his assent according to the form of the Statute in such Case Lately made and provided adjudged and the afd Thos have thereof Execution &c
answer unto George Tull of a plea of trespass upon the Case &.c and that thereof he should not fail &c Att which said third tuesday of June to witt the seventeenth day of the Same month anno Dom one thousand seven hundred and twenty Nine being the day of the return of the said Writt Cometh the said George Tull by Levin Gale his attorney and the sher of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof Endorsed in these words following vizt Cepi Corpus P Jno Purnall sher And the afd Griffin Thomas by Francis Allen his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also &c Att which said next Court to witt the Ninteenth day of August ann.o Dom one thousand Seven hundred and twenty Nine Cometh the afd Griffin Thomas by his attorney afd and the afd George Tull then and there his writt afd against the afd Griffin Thomas did not prosecute with Effect but voluntaryly permitted his Suit to be discontinued Therefore afterwards to witt the same day by discretion of the Justices here were adjudged 250 to the Same Griffin Thomas Two hundred & fifty pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained according to the form of the Statute in Such Case Lately made and provided and that the afd George Tull be in Mercy and that the afd Griffin have thereof Exn &c
