211 Twenty Eight at somersett County aforesaid within the Jurisdiction of this Court was Indebted unto the said Francis Mercer in the Sum of Twelve pounds thirteen Shillings and five pence Curr.t mony of maryland for sundry goods wares and Merchantdizes by the said francis to the said Philip at the Special Instance and request of the Said Philip before that time sold and delivered as by acco.t hereunto annexed may appear and being so thereof Indebted the said Philip in Consideration thereof the day and year afd at ye County afd upon himselfe did assume and to the said Francis Mercer then and there did faithfully promise that he the said Philip the said Twelve pounds thirteen shillings and five pence Currant mony to the said Francis Mercer when thereunto afterwards he Should be requested he would well and faithfully pay and Content and altho' the said Philip four pounds Eight Shilling and four pence halfe penny pcell of the afd twelve pounds thirteen Shillings and five pence to the afd Francis Mercer he hath paid and satisfied yett as to Eight pounds five Shillings and one penny halfe Penny residue thereof the said Philip his promise and assumption afd in form afd made nothing regarding but plotting and fraudulently Intending the said francis Mercer in that ^part^ Craftilly and Subtilly to deceive and defraud the said Eight pounds five Shillings and one halfe Penny to the said francis Mercer altho' the same to do the said Philip on the afd first day of March in the year afd and often afterwards at the County by the said francis Mercer he was thereunto requested hath not paid or to him for the same in any wise Contented but the same to him hitherto to pay or in any sort to Content hath refused and Still doth refuse and deny whereupon he Saith he is worse and hath damage to the value of sixteen pounds Mercy afd and thereupon he brings this Suite &.c F Allen P Quer Pledges &c Jno Do Roe
Whereupon the said Philip Taylor being Called appears and thereupon the Said Philip Taylor at the prayer of the plft by his attorny afd is adjudged to give Speciall bail to the action aforesd but for want thereof the said Philip Taylor is Committed into the Custody of the Sher of Somersett |
