210 in the Sum of forty bushells of Indian Corn as by a note by the same Thomas Signed in Court herewith produced may appear and so thereof being Indebted the said Thomas in Consideration thereof afterwards viz.t the Same day and Year afd at the County afd and Within the afd Jurisdiction upon himselfe assumed and to the Same Ebenezer and Benjamin then and there faithfully promised that he when afterwards he Should be thereto required he the afd Sum of forty bushells of Indian Corn to the Same Ebenezer and Benj.a would well and faithfully Content and pay Nevertheless the Said Thomas his promise and assumption afd in form afd made not regarding but Plotting and fraudulently Intending them the same Ebenezer and Benj.a in that part Craftilly and Subtilly to deceive and defraud the afd Thomas the Said sum of forty Bushells of Indian Corn or any Part thereof to the Same Ebenezer and Benj.a he the hath not paid altho' the Same to do the afd Thomas afterwards vizt the same day and year aforesaid at the County afd and within the afd Jurisdiction by the Same Ebenezer and Benjamin was requested but the Same hitherto to do hath altogether refused and Still doth refuse whereby the same Ebenezer and Benj.a say they are worse and have damage to the Value of Eighty Bushells of Indian Corn and thereof they bring this Suit &.c G Dashiell P Quer Pledges &c Jno Doe R Roe And the afd Thomas Hearn by francis Allen his attorney Cometh and defendeth the force and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and they he hath it and the Same day is Given to the afd Plfts here also &c Att which said next Court to witt the Seventeenth day of June anno Dom One thousand Seven hundred and Twenty Nine Came again as well the afd Ebenezer Handy and Benja Handy by their attorney afd as the afd Thomas Hearn by his attorney afd and Whereupon the said Thomas Hearn by his said attorney prayed further Leave thereof to Imparle hereunto untill the next Court and he hath it and the Same day is Given the afd Plfts here also &c Att which said next Court to witt the Ninteenth day of august anno Dom one thousand Seven hundred and twenty Nine Came again as well the afd Ebenezer and Benjamin Handy by their attorney afd as the afd Thomas Harn by his attorney afd and Whereupon the Said Thomas Hearn by his said attorney afd before defends the force and Injury when &.c And saith that he did not assume upon himselfe in manner and form as ye Plfts in their declaration against him hath Complained and of this he putts himselfe upon the Country &c and ye afd Plfts Likewise &c Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &c of which said Preceipt the Said Sher to witt John Purnall Gent Now hereat this day to witt the Same day and Year Last mentioned makes return that he hath here ready twelve &.c as by his said preceit he was Commanded and now hereafterwards to witt the same day and year Came as well the afd Plfts as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled |
