       August Court        1729                209

for the rent of five years ending the twenty first day of December one thousand Seven Hundred and twenty
five to the said Robert in his life time was in arrear and remaining unpaid by which action accrewed to the said Robert
in his Life time to require and have of the afd John the aforesaid fifteen hundred pounds of tobacco and fifty
bushells of Indian Corn Yett the afd John tho' often by the said Robert in his lifetime and by the said Archibald
since the death of the said Robert thereunto required the said fifteen hundred pounds of tobacco and fifty bushells
of Indian Corn to the Said Robert in his life time or to the said Archibald since the decease of the said robert hath
not rendered but the Same to render hath denyed and the said John the same to the said Archibald to render
still doth deny and unjustly detain to the retarding him in the Execution of the Last and Will and testament
afd whereupon the said Archibald Saith he is worse and hath damage to the value of twenty pounds Currant
money of Mary and thereupon he brings suit &.c and brings into Court here the Letters testamentary of the afd
Robert by which it plainly appears the afd Archibald to be Executor and thereupon to have administracon &c

                            And the afd John Pepper by George Dashiell his attorney Comes and defends the force &
Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same
day is given to the afd Plft here also &c

                                    Att which said next Court to witt the Seventeenth day of June anno Dom one
thousand seven hundred and twenty Nine Came againe as well the afd Archibald Smith Executor as afd as
the afd John Pepper by their attorneys afd and whereupon the said John Pepper by his said attorney
prayed further leave thereof to Imparle hereunto untill the next Court and he hath it and the same day
is given to the afd Archibald here also &c

                               Att which said next Court to witt the Ninteenth day of August anno Dom One thousand Seven
hundred and twenty Nine Came again as well the afd Archibald Smith Executor as afd by his attorney as afd as
the afd John Pepper by his attorney afd and Whereupon the Said John Pepper by his said attorney as before
defends the force and Injury when &.c and says that he Cannot gainsay the action afd of the afd Archibald
nor but that he doth detain from the said Archibald the afd Fifteen hundred pounds of tobacco and fifty
bushells of Indian Corn in manner and form as the aforesaid Archibald above against him hath declared &c

                   Therefore it is Considered that the afd Archibald Smith Executor of the Same robert Perrie
Recover against the afd John Pepper his debt afd to fifteen hundred pounds of tob.o and fifty bushells
of Indian Corn and his damages by Occasion of the detaining of the Same Debt to four hundred and six
406                                pounds of tobacco to the same Archibald of his assent by the the Court here
adjudged and ye afd deft in Mercy &c

    Twenty Eighth day of September anno Dom One thousand Seven hundred and twenty Eight at Somersett
County within the Jurisdiction of this Court was Indebted unto the Same Ebenezer and Benjamin
