1727 20 pay or the same Alexander any Manner of Way to save Harmless hath altogether refused and Still doth refuse to the Damage of the Same Allexander ten pounds Curr.t Mony & three thousand pounds of tob.o and thereof he Brings this Suite &c L Gale P Quer Pledges &.c Jno Doe Richd Roe And the said William Smith by George Dashiell his attorney Comes and Defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt twentieth day of March anno Dom One thousand Seven hundred and twenty Six Came againe as well the afd Alexander Hall as the afd William Smith by their attorneys afd and the afd William by his said attorney prays further Leave thereof to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt the twentieth day of June anno Dom One thousand seven hundred and twenty seven Came againe as well the afd Alexander Hall as the afd William Smith by their attorneys afd and the afd Alexander by his said attorney prays that the afd William to his declaration afd may Answer &c whereupon the afd attorney of the Same William Says that he is not Informed by the Same William his Clyant of any answer for the Same William to the afd Alexander in the plea afd to be given and nothing else thereof says by which the same Alexander Remaineth against the afd William thereof undefended wherefore the afd Alexander his damages by occasion of the premisses ^afd^ against the afd William ought to Recover but because it is not known what damages the afd Alexander ^hath^ sustained by occasion of the premisses afd therefore Command is to the Sherr of Somersett County that by the Oath of honest and Lawfull men of his Bailywick he diligently Inquire what Damages the afd Alexander hath sustained as well by occasion of the premisses afd as for his Costs and Charges by him about his suite in that part Expended And the Inquisition which thereof he should take to his Lordship's Justices at the next Court to be held for the County afd the third tuesday of August next at Dividing Creek under his seal and the seal of them by whose Oath he ^should^ take the Same Inquisition he send together with the writt thereof to him directed and the same day is given to the afd Willm here also &c Att which said third tuesday of August to witt the fifteenth day of the same month anno Dom one thousand seven hundred and twenty seven before his ^said^ Lordship's Justices of the peace at Dividing Creek Cometh the afd Alexander Hall by his attorney afd and the Sherr Returned a Certain Inquisition before him taken at the head of manokan river at the bridge in manokan hundred in the County afd the twelfth day of August and Year afd by which it appears that the afd Alexander Hall ^hath^ Sustained Damages by Occasion of the premisses afd beyound his Costs and Charges by him about his Suite Expended to Nine hundred and forty six pounds of tobacco and two pounds three shillings Curr.t money and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the afd Alexander Hall Recover against the afd William Smith Nine hundred and forty seven pounds of tobacco and two pounds three shillings Currt money his Damages afd ^as^ by the Inquisition appears as also seven hundred and Eighty Nine pounds of tobo for |
