provided for his Costs and Damages which he sustained by Occasion of delay of Execution of
the Judgm.t afd to be Levied of the goods and Chattells which were of the afd Thomas Taylor
at the time of his death remaining and which to the hands of the afd Henry Williams and
Alice his wife hereafter shall happen to come to be administred &c

 Somersett fs  William Smith Late of Somersett County Planter was attached
to answer unto Allexander Hall of a plea of tresapass upon the Case &c
And whereupon the same Alexander by Levin Gale his attorney
    complaines that whereas a Certain William Francis the sixteenth day of June anno
    Dom one thousand Seven hundred and twenty four in Somersett County within ye Jurisdiction
    of this Court was by a Certain Capell King attached to answer him in Somersett County Court of
    a plea of trespass upon the Case and the said William Francis by the Judgm.t of the said
    Court the day and year afd was Ordered to give Speciall Bail in the said Action and ye afd
    William Smith having Communication with the afd Alex.d about the said affair ^Francis^ ye afd day &
    Year at Somersett County afd within the Jurisdiction of this Court in Consideration that the
    same Alexander would at his Especiall Instance and request Become Bail for ye afd Will.m
    Francis as afd he the said William Smith upon himselfe assumed & to ye said Allex.d then & there
    faithfully promised that he the said William Smith ^to^ the afd Alex.d would save harmless and him
    from all Damages and Costs which he should sustain by Occasion thereof wou'd well and faithfully
    Content and pay and the afd Alex.d in Fact says that he the said Alex.d trusting to the promise &
    assumption afd of ye afd William Smith so as afd made the day and Year afd at ye County afd
    and within the afd Jurisdiction in the County Court afd at the Especiall Instance & request of ye said
    William Smith did become Speciall Bail for the said W.m Francis whereby the said Allex.d
    afterwards to wit ye tenth day of June Anno Dom One thousand seven hundred & Twenty Six at
    the County afd and within the afd Jur did Sustain damage and to the afd Capell King hath been
    oblidged to pay two pounds three Shillings Currt mony & Nine hundred ^and^ forty six pounds of
    tob.o of which the said William Smith afterwards to witt ye same day and Year afd Last mentioned
    at the County afd and within the afd Jurisdiction by the Same Alex.d had Notice & then & there
    was requested to save the same Allex.d Harmless and to pay him the said Sum of two pd.s three shill.s
    Curr.t Mony and Nine hundred and forty Six pd.s of tob.o Nevertheless ye same W.m Smith his
    Promise and assumption afd in form afd Made not Regarding but plotting & fraudulently
    Intending him the same Alex.d in that part Craftilly & Subtilly to Defraud and Deceive he
    the said William hitherto to the said Alexd the said sum of mony & tob.o or any part thereof to
