209 she Barr of the Verdict of and upon the premisses afd to render between themselves to Commence did recede and afterwards to the barr for their Verdict in that part to render returneth whereupon the afd John Howston altho' Solemnly Called Cometh not nor is his writt and declaration abovesaid further prosecuted against the said George Doughlass &.c Therefore it is Considered by the Court here that the afd John Howston take nothing by his writt and declaration afd but that he and his pledges of Prosecuting to witt Jno Doe and richard roe be in mercy and that the afd George Doughlas Executor as afd goe thereof without day &c and further it is Considered that the afd George Doughlas recover against the afd John Howston 535 pounds of tobacco for his Costs and Charges by him about his defence in that Part sustained to the same George by the Court here adjudged according to the form of the Statute in Such Case Lately made and Provided and that the same George have thereof Execution &c
of the Last will and testament of of Robert Perrie dec.d of a plea that he render unto him fifteen hundred pounds of tobacco and fifty bushells of Indian Corn which from him he unjustly detaines &.c And whereupon the said Archibald by Francis Allen his attorney saith that by a Certain Indenture made at the County of Somersett afd within the Jurisdiction of this Court the Twenty Second day of May One thousand Seven hundred and twenty One between the afd Robert Perrie in his Life time by the name of Robert Perrie of Sussex County on Delaware in Luestown Schoolmaster of the one part and the aforesaid John by the Name of John Pepper of Somersett County and province of Maryland Planter of the Other part which said Indenture the Said Archibald with the Seales of the Said Robert and John Signed hereinto Court brings the date whereof is the same day and year the said Robert in his said Lifetime did demise and to farm lett unto the said John Pepper his heirs Exrs and administrators all that his the said Roberts Messuage and Plantation Named and Called Bangrove in Somersett County at the the Seaside with all its Edifices ^buildings^ Orchards woods and all and Every its appurtenances thereunto belonging from the twenty first day of December then last past before ye date of the said Indenture for and dureing and ^to the^ full end and term of five years from the day afd fully to be Compleat and Ended Yeilding and paying therefore yearly and each year unto the said Robert his heirs Executors adm.rs assignes or Certain attorney during the term afd the Just and full quantity of three hundred pounds of tobacco good sound merchantable tobacco and ten bushells of Goods and Shilled merchantable Indian Corn for the yearly rent of the said Plantation at or upon the twenty sixth day of December Yearly and Every Year during the term of the said Lease at snow Hill in Somersett County afd within the Jurisdiction afd as by the said Indenture more fully appears by vertue of which Lease the said John the aforesaid twenty second day of May in the year afd into the Mussuage and plantation afd with the appurtenances did enter and was by the Space afd in the lease afd mentioned of the same possessed and fifteen hundred pounds of tobacco and fifty bushells of Indian Corn for |
