           August Court             1729                 208

    of may seventeen hundred and twenty Eight and Often afterwards at Somersett County afd within the Jurisdiction
    afd they were thereunto requested have not paid nor any of them Hath paid or Contented but the Same to the said
John to pay the Said Drak in his Life time and ye said Hill in his said Capacity after the death of the said
Drake and ye afd George in his said Capacity since ye decease of the afd Hill and Drake have hitherto altogether
Refuses and Every of them have refused and the Said George the Same to the said John to pay still
doth deny whereupon he Sayeth he is worse and hath damage to the value of five pounds seven shillings
and six pence mony afd and thereupon he brings this Suite &.c   F Allen P Quer Pledges &.c Jno Doe R Roe

             And the afd George Doughlass by Levin Gale his attorney Comes and defends the force and Injury
when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and Same day is
Given to the afd Plft here also &.c

       Att which said next Court to witt the Eighteenth day of March anno Dom One thousand seven hundred and
twenty Eight Came again as well the afd John Howston as the afd George Doughlass by their attorneys afd
and the afd George Doughlas by his said attorney prays further Leave to Imparle here unto untill the next
Court and he hath it and the Same day is given to the afd Plft here also &c

                          Att which said next Court to witt the seventeenth day of June anno Dom One thousand seven
    hundred and twenty Nine Came again as well the afd John Howston as the afd George Doughlas by their
attorneys afd and whereupon the same deft by his said attorney prays further Leave thereof to Imparle
hereunto untill the next Court and he hath it and the Same day is Given to the afd Plft here also &c

                         Att which said next Court to witt the Ninteenth day of August Ann.o Dom One thousand
    seven hundred and Twenty Nine Came again as well the afd John Howston as the afd George Doughlas
by their attorneys afd and whereupon the same George Doughlas by his said attorney as before defends
ye force and Injury when &.c and prays Judgm.t of the writt afd because he says that he never was Executor
of the testament of the afd Hill nor any of the goods or Chattells which were the afd Hill as Executor
of the said Hill ever administred and this he is ready to verifie wherefore he prays Judgm.t of the writt
afd and that ye Said Writt may abate &c

                      And the said John saith that the writt afd by any thing in the defts plea above alledged
    Ought not to abate because he Saith that the Said George at Somersett County within the Jurisdiction of this
Court before the suing out of the writt afd against him the said George vizt the thirtieth day of august aprill
Anno Dom One thousand Seven hundred and twenty Eight did take upon himselfe the burthen of Executor &
Sundry goods and Chattells of ye dec.d at the time of his death did administer and to his own use Convert and
this he prays may be Enquired of by the Country &.c   and ye Deft in Like manner

                      Thereupon Command is given to the Sher of Somersett County that Immediately he Cause to Come here
twelve &.c by whom &.c who neither &.c to recognize &.c because as well &.c of which said preceipt the said Sher
to witt John Purnall Gent Now hereat this day to witt this Ninteenth day of August anno Dom one thousand
Seven hundred and twenty Nine Comes and makes Return that he hath here ready twelve &c as by his said
preceipt he was Commanded and Now hereafterwards to witt the same day and year Last Mentioned
Comes as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled
being Called ^likewise^ Came to witt Thomas Laws, francis Lancake, John Onorton, James Jones, John Townsend
Jun.r, Nehemiah Holland, John Webb, John Huett Nutter, Robert Watson, Samuel Taylor, John
Shockley ^Samuel Hopkins Jun.r^ who being duely Elected tryed and Sworn to Say the truth in the premisses and from
