    of the promise and assumption afd beyound his Costs and Charges by him about his Suit in that part Expended
to One thousand two hundred and twenty pounds of tobacco and for those Costs and Charges to one
pound of tobacco
                                     Therefore it is Considered that the afd Joseph MccClester Recover against the
afd Abraham Cordery his Damages afd to One thousand two hundred and thirteen pounds of tobacco as by ye
536    Inquisition afd above appears as also                                                                             pounds of tobo
for his Costs and Charges by him about his Suit in that part apposed to the Same Joseph by the Court
hereof at his request of Increase adjudged which Certain Damages in the whole do amount to
                                                       pounds of tob.o and ye afd deft in mercy &c

                                              of said County of Somersett planter dec.d was attached to answer unto John Howston of
    a plea of trespass upon the Case &.c

                                                                           And whereupon the said John by Francis Allen his attorney Complains
that whereas the said Drake in his Life time to witt the first day of November ann.o Dom One thousand
seven hundred and ninteen at Somersett County afd within the Jurisdiction of this Court was Indebted unto
the said John in three pounds nine shillings and nine pence Currant money of Maryland as p by account
hereunto annexed and herein Court produced may appear and being so thereof Indebted the said Drake in
his life time to witt the first day of November in the Year afd at the County afd in Consideration thereof
upon himselfe did assume and to the said John then and there did faithfully promise that he the said
Drake the said three pounds Nine shillings and nine pence to the said John when he should be
afterwards thereunto requested he would well and faithfully pay and Content and altho' the said
Drake in his Life time sixteen shillings pcell of the afd three pounds Nine shillings and Nine pence
to the said John he paid and Satisfied Yett as to two pounds thirteen shillings and Nine pence
residue thereof the afd Drake in his Life time and the afd Hill in his said Capacity in his life time
and the afd George in his Capacity afd made the promise and assumption afd of the afd Drake
in his Life time so as afd made nothing regarding but plotting and fraudulently Intending and
Every of them plotting and fraudulently Intending the said John in that Part Craftilly and Subtilly
to deceive and defraud the said two pounds thirteen shillings and Nine pence to the said John
altho' the same to do the said Drake in his Life time to witt the afd first day of November in
the Year afd and Often afterwards and the afd Hill in his Life time after ye decease of the said
Drake to witt the second day of aprill seventeen hundred and twenty two and Often afterwards
and ye afd George since ye Decease of the said Hill and Drake to witt on the first day
