203 said William when thereunto afterwards he Should be requested he would well and faithfully pay & Content yett nevertheless the said James his promise and assumption afd in form afd made nothing Regarding but Plotting and fraudulently Intending the said William in that part Craftilly and Subtilly to deceive and defraud the said Six hundred and Eight pounds of tobacco to the said William altho the same to do the said James on the afd tenth day of Aprill in the ^year^ afd and often afterwards at ye County afd by the said William he was requested hath not paid or to him in any sort Contented but the same to him hitherto to do or in any sort to Content hath refused and still doth refuse and deny whereupon he saith that he is worse and hath damage to the value of six twelve hundred & sixteen hund pds of tobacco and thereupon he brings this Suite &.c F Allen P Qur Pledges &c Jno Do R Roe Aprill assize 1724 M.r James Feillett Dr
And the said James Feillett in his Own properson Comes and defends the force and Injury when &.c and Says that he Cannot gainsay the action afd of the afd William nor but that he did assume upon himselfe in manner and form as the afd William above against him hath Complained and as to the damage of the Same William by him by Occasion of the premisses in that part Sustained the Same James says and Confesseth that the afd William hath Sustained damage by occasion of the premises besides ^his^ the Costs and Charges by him about his Suit in that part apposed to six hundred and Eight pounds of tobacco and not more and becaus the afd William denys not this but the same allegation Confesseth to be true prays Judgm.t and those damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the parties afd it is Considered that the afd William Marchment Recover against the afd James Feillett his damages afd to Six hundred and Eight pounds of tobacco by the same James in form afd Confessed as also Two hundred & Eleven pounds pounds of tobacco for his Costs and Charges afd to the Same W.m at his request by the Court here adjudged which Certain damages amounts in the whole to Eight hundred & Ninteen pounds of tobo with Stay of Execution till the tenth day of Novem Next and ye afd deft in Mercy &c The Court adjourns till the third tuesday of august ann.o 1729 |
