          June Court    1729             203

Instance and request of the said Ralph then and there sold and delivered and being so thereof
Indebted the said Ralph in Consideration thereof the day and year afd at the County afd upon himselfe
did assume and to the said John then and there faithfully did promise that he the said Ralph
the said Eight Pounds Curr.t money of Maryland afd to the said John when thereunto afterwards
he should be requested he would well and faithfully pay and Content nevertheless the said Ralph
his promise and assumption afd in form afd made Little regarding but Plotting and fraudulently Intending
the said John in that Part Craftilly and Subtilly to deceive and defraud the said Eight pounds
Currant mony of Maryland afd to the said John altho the same to do the said ralph on the afd
first day of August in the Year afd and often afterwards at the County afd by the said John he
was thereunto requested hath not paid or him for the same in any wise Contented but the same to him
hitherto to pay or in any sort to Content hath Refused and Still doth Refuse and deny whereupon
he saith he is worse and hath damage to the value of sixteen pounds Currant money of Maryland
afd and thereupon he brings this Suite &.c   F Allen P Quer Pledges &.c   Jno Doe  R Roe

             Att which said third tuesday of June to witt the seventeenth day of the Same Month anno Dom
One thousand seven hundred and Twenty Nine Came aga the said John Blizard by his attorney afd and the
Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return
thereof to the Court here Endorsed viz.t   Non est Inventus P Jno Purnall sher

             Whereupon the said John Blizard by his attorney afd Prays that for as much as he has
Complyed with the Law as alledged in order to an attachm.t he may have Judgm.t against the said
Ralph Tindall for his damages afd by way of attachment according to act of assembly &c

                Whereupon for that it seems to the Court here that the afd John Blizard hath Complyed
with the Law afd
                                     Therefore it is Considered that the afd John Blizard Recover against the
afd Ralph Tindal his damages afd to Eight pounds Curr.t mony as also all Costs and Charges by the
185   said plft laid out and Expended about his Suit by way of attachment against the goods Chattels
Rights or Creditts of the said Ralph Tindall according to act of assembly in such Case made and
Provided &c

County Chirugion was attached to answer unto William Marchment of
a plea of trespass upon the Case &.c
                   And whereupon the said William by Francis Allen his attorney Complains that
whereas the said James the tenth day of April Anno Dom One thousand Seven hundred and
twenty four at Somersett County afd within the Jurisdiction of this Court was Indebted unto the said
William in Six hundred and Eight pounds of tobacco as by account hereunto annexed may appear
in Court and being so thereof Indebted the said James in Consideration thereof the day and
year afd at ye County upon himselfe did assume and to the said William then and there faithfully
did promise that he the said James the said Six hundred and Eight pounds of tobacco to the
