200 Eight nine at Stepney Parish in somersett County afd within the Jurisdiction of this Court was Indebted unto the Said Patrick in the Sum of two pounds seventeen shillings and five pence Currant money of Maryland as by an account hereunto annexed may in Court appear and so thereof being Indebted the said Joseph in Consideration afd at the time and place afd did upon himselfe assume and to the same Patrick then and there did faithfully promise that the afd sum of two pounds Seventeen Shillings & five pence he would pay and Content when he Should be thereto requested Nevertheless the same Joseph his promise and assumption afd in form afd made Little Regarding but Plotting and fraudulently Intending him the said Patrick in that Part to deceive the afd Sum of two pounds seventeen shillings & five Pence he hath not Paid but the Same to pay hath denyed and Still doth deny to the damage of the same Patrick of six pounds Like money and thereof he brings this suite Dashiell p Quer Pledges Jno Do R Roe Joseph Houlder Jan.r 18 1728/9 Bought of Patrick Sympson
Personally appeared before me the Subscriber one of the Lord Proprietors Justices of the Peace for Somersett County Capt Patrick Sympson and made Oath on the Holy Evangelist of Almighty God that the above account is Just and true as it Stands Stated and that he hath Rec.d no part or Parcell thereof In testimony whereof I have sett my hand and Seal this 6th day of March 1728/9 John Handy And the said Joseph Holder in his Own Proper person Comes and defends the force and Injury when &.c and says that he Cannot gainsay the action afd of the afd Patrick nor but that he did upon himselfe assume in manner and form as the afd Patrick above against him Complained and as to the damage of the Same Patrick by him by occasion of the premisses in that part sustained the same Joseph says and Confesseth that the afd Patrick has sustained damage by Occasion of the premisses besides his Costs and Charges by him about his suit in that part opposed to two pds seventeen shillings and five pence Currant Mony and not more and because the afd Patrick this not denys but the same allegation Confesseth to be true prays Judgm.t and those damages above Confessed to gather with his Costs and Charges afd to him adjudged &.c Therefore by Consent of the Partys afd it is Considered that the afd Patrick Simpson Recover against the afd Joseph Holder his damages afd to the afd two pounds seventeen shillings and five pence Curr.t mony by the same Joseph in form afd Confessed as also Two hundred & thirteen 213 pounds of tobo for his Costs and Charges afd to the same Patrick at his request by ye Court here and of the Consent of the Parties afd adjudged which Certain damage in the whole do amount to two pounds seventeen shillings and five pence and pds of tobo and ye afd deft in Mercy &c |
