                                        William Dulany late of Somersett County Planter
was attached to answer unto Patrick Simpson of a plea of trespass upon ye
Case &.c   And whereupon the same Patrick Simpson by George Dashiell his attorney Complaines
that whereas the Same William on the twenty Sixth day of february ann.o Dom one thousand
seven hundred and twenty Eight Nine at Stepney parish in Somersett County afd within the Jurisdiction
of this Court was Indebted unto the same Patrick in the Sum of nine pounds fifteen shillings
and five pence halfe Penny for sundry goods and Merchantdizes before that time sold and delivered
as p.r account hereto annexed may in Court appear and the same William being Indebted as afd
for and In consideration aforesaid at the time and Place afd upon himselfe assumed that the
afd sum of Nine pounds fifteen shillings and five pence halfe penny he would well and truely
Content and pay when he should be thereunto requested  Nevertheless the said William his promise
and assumpsion afd in form afd made not regarding but Contriving him the said Patrick to deceive &
defraud the afd sum of Nine pounds fifteen Shillings and five pence halfe Penny Currant
mony of Maryland he hath not paid tho often thereto requested but the same to do hath refused
and still doth refuse to the damage of the same Patrick of twenty pounds Like mony and
thereof he brings this suit

                    Personally appeared before me the Subscriber One of his Lordships Justices
                    of the Peace for Somersett County Capt Patrick Sympson and made Oath on the Holy
Evangelist of almighty God that the above account is Just and true and that he hath rec.d noe
part thereof more than he hath Given Creditt for and that the Just Ballance due to him is £9:15:5:½
to the best of his Knowledge in testimony whereof I have sett my hand ye day & year above

                         And the afd William Dulany in his Own proper person Comes and defends the
force and Injury when &.c and says that he Cannot Gainsay the action ^afd^ of the afd Patrick nor but
