19 Court at dividing Creek and by consideration of our said Court obtained his Execution of a Certain Judgm.t against a Certain Henry Williams of Stepney Parish of Somersett ^in the^ County afd planter and alice his wife admrx of a Certain Thomas Taylor late of Somersett County dec.d as well of the Sum of Eight hundred and Eighty five pounds of tobacco a Certain debt together with the sum of two hundred and fifteen pounds of tobacco Costs of Suit as also the Sum of two hundred and sixty one pounds of tobacco by the Court here adjudged for additionall Costs in the Judgm.t Specified as also the sum of two hundred and twenty three pounds of tobacco by the Court here adjudged unto the said Benj.a for his Costs and damages sustained by Occasion of Delay of Execution of the Judgm.t afd all which sum's afd to be Levied on ye the goods and Chattells which were of the afd Thomas Taylor at the time of his death and which to the hands of the afd Henry Williams and Alice his wife admrx as afd should after Come to be administred if so much thereof in their hands they have whereof they are Convict as by the Records and proceeding thereof in Our said Court Remaining before Our Justices at Dividing Creek manifestly appeareth and altho' the Judgm.t afd as yett Remaineth unsatisfyed as by the Insinuation of the said Benja we have Received and because we are willing that those things which in Our said Court are Rightfully done Should Come to a due Execution we Command you that by good and Lawfull men of your Bailywick you make known unto the afd Henry Williams and Alice his wife that they be and appear before Our said Justices at Our County Court of Somersett to be held at Dividing Creek the third tuesday of August next to Shew Cause if any thing for themselves they have or knoweth to say wherefore the afd Benj.a his Execution of the Judgm.t afd against the afd Henry Williams and Alice his wife admrx as afd according to the form of the Recovery afd he ought not to have if to them it shall seem Expedient and have you then and there the names of those before whom you make the same known and this Writt Wittness Saml Hopkins Gent &c Att which said third tuesday of August to witt the fifteenth day of the Same month anno Dom one thousand seven hundred and twenty Seven being the day of the Return of the said Writt Cometh the afd Benj.a Wailes by his attorney afd and the sherr Returned of that by vertue of his Lordships writt afd to him directed he had made known unto the afd Henry Williams and Alice his wife admrx as afd that they be before his said Lordships Justices at dividing Creek the third tuesday of august then Next that is to say by John Doe and Richard Roe honest and Lawfull men of his Bailywick &c And the afd Henry Williams and Alice his wife admrx as afd altho' so before warned being Solemnly Called Came not but made default &c Therefore it is Considered by the Court here that the afd Benja Wailes have his Ex.n against the afd Henry Williams and Alice his wife adm.rx of the afd Thomas Taylor for as well the sum of fifteen hundred and Eighty four pounds of tobacco his debt and Costs afd above specifyed as also the Sum 226 of Two hundred & twenty Six pounds of tobacco which to ye afd Benjamin by the same Court here were adjudged according to the form of the statute thereof Lately made and provided for |
