2 hundred and twenty six Came again as well the afd Ebenezer Cooke as the afd John Bishop by their attorneys afd and ^whereupon^ the same John Bishop by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt the twentieth day of June Anno Dom One thousand Seven hundred and twenty Seven Came againe as well the afd Ebenezer Cooke as the afd John Bishop by their attorneys afd and whereupon the said John Bishop by his said attorney as before defends the force and Injury when &c And saith that he doth not detain from the afd Ebenezer Cooke the within mentioned gelding in manner and form as the Plft against him hath Complained and of this he putts himselfe upon the Country and the afd Plft likewise Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to come here twelve &c by whom &c who neither &c to recognize &c because as well &.c of which said preceipt the said Sherr to witt Francis Allen Gent Now here at this day to witt the Same day and year last mentioned makes Return that he hath here Ready twelve &.c as by his said preceipt he was Commanded and Now hereafterwards to witt the same day and year Came as well the afd Plft as the afd Deft by their attorneys ads and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Holland, Robert Collier, Isaac Marshall, William Corde, Isaac Brittingham, W.m Dixon, John Purnall, Revell Horsey, Thomas Laws, Thomas Peal, Charles Townsend, Bruffe Broughton who being duely Elected tryed and Sworn to say the truth in the premisses and after the Same Jurors were by the Court Charged Concerning their Verdict and from the Barr here to Command ^together^ amongst themselves of and Concerning their giveing in of their Verdict afd in the premisses afd did recede and thereof amongst themselves being fully agreed, Came againe to the barr to give in their Verdict but ye said Ebenezer Cook altho' Solemnly Called Came not nor is his writt abovesaid against the said John Bishop further prosecuted Therefore it is Considered by the Court here that the afd Ebenezer Cooke take nothing by his writt and declaration afd but that he and his pledges of Prosecuting that is to say John Doe and Richard Roe be in mercy and that the afd John Bishop go thereof without day &c and further it is Considered that the afd John Bishop Recover against the afd Ebenezer Cooke Nine hundred & 937 thirty seven pounds of tobacco for his Costs and charges by him about his defence in that part Expended to the same John by the Court here according to the form of the Statute in Such Case ^lately^ made and provided adjudged and that the same Jno have thereof Execution &c
that whereas the afd William the tenth day of march anno Dom One thousand Seven hundred & twenty six at Somrsett County within the Jur of this Court was Indebted to ye Same Randall in ye Sum of Six hundred pence & so thereof being Indebted (the) |
