                June Court         1727                    3

    the Said W.m in Consideration thereof afterwards to witt ye same Day & year afd  
    att ye Co.ty afd & within ye Jur upon himselfe assumed & to ye same randall then
    & there faithfully promissed yt he when afterwards he shoud be thereto requested
    he ye afd Sum of six hundred pence to ye same randall woud well &
    faithfully Content & pay Nevertheless ye said W.m his promisse & assumption
    afd in forme afd made not regarding but plotting & fraudulently Intending
    him ye Same Randall in yt part Craftilly & Subtilly to Defraud & Deceive
    ye afd Six hundred pence or any part thereof to ye same randall he hath not
    paid although ye same to doe ye afd W.m afterwards viz.t ye same day & year afd
    at ye Co.ty afd & within ye afd Jur: by ye same Randall was requested but he ye same
    hitherto to doe hath altogether refused & Still doth refuse whereby ye same
    Randall sayes he is worse & hath Dam to ye value of twelve hundred pence &
    thereof he brings this Suite &a               L Gale P Quer &a Jno Doe & R.d Roe

And the afd William Pointer in his Own proper person Comes and defends the force and Injury when
&c and says that he Cannot gainsay but ^that^ he promised and assumed upon himselfe in manner and form
as the afd Randall above against him declared nor Can he say but that he Owes the afd Randall
the afd Six hundred pence and the declaration in all the words before Expressly Confesseth

             Therefore it is Considered by the Court here the twentieth day of June anno Dom one thousand
Seven hundred and twenty Seven that the afd Randall West Recover against the afd William Pointer Six
(222)   hundred pence his Damages afd as also Two hundred & Twenty Two            pounds of tob.o
for his Costs and Charges by him about his Suite in that part Expended to the Same Randall by the Court here
of his assent adjudged and the afd Deft in Mercy &c

         was attached to answer unto Benj.a Wailes of a plea of Trespass
upon ye Case &a         And whereupon ye same Benj.a by Levin Gale
                        his attry Complaines yt whereas ye afd Michael ye tenth day of June
            Anno Dom one thousand Seven hundred & twenty five at Somrsett Co.ty within
ye Jur of this Court was Indebted unto ye Same Benj.a in ye Sum of twelve
hundred & Ninety p.ds Tob.o as by a note Signed with ye hand of ye Same Michael
hereinto Court by ye Same Benj.a brought may apear & so thereof being Indebted
the said Michael in Consideration thereof afterwards to witt ye Same Day & year
afd at ye Co.ty afd & within ye afd Jurisdiction upon himselfe assumed & to ye
same Benj.a then & there faithfully promissed yt he when afterwards he shoud
be thereto requested he ye afd Sum of twelve hundred & Ninety p.ds Tob.o to ye
Same Benj.a woud well & faithfully Content & pay Nevertheless ye s.d Michael
his promiss & assumption afd in form afd made not regarding but plotting and
