      August Court       1727                 19

of twelve hundred pounds of tobacco so as afd Confessed by the afd Levin Gale as of the Rights and
Creditts of the said Ebenezer Cook may be Condemned in the hands of the said Levin Gale towards satisfying
unto the said John Bishop as well the afd sum of Nine hundred and thirty seven pounds of tobo the
Costs mentioned in the attachm.t afd as all Costs accrewing upon this our writt of attachmt afd &c

                      Therefore it is Considered by the Court here that the afd Sum of twelve hundred pounds
of tobacco so as afd Confessed be Condemned in the hands of the said Levin Gale as of the rights and
Creditts of the said Ebenezer Cook towards satisfying unto the said John Bishop as well the sum of
Nine hundred and thirty seven pounds of tobo the Costs in the writt of attachmt afd mentioned as also the
Costs accrewing upon the writt of attachm.t afd and that the said John Bishop have thereof his Execution
against ye said Levin Gale according to act of assembly &c

     This being an action of trespass upon the Case &c wherein the
Sherr of Somersett County to whom the writt in the same action was directed
Comes and makes Return thereof to the Court here Endorsed in these words
    following vizt Cepi Corpus P Francis Allen sherr

             Whereupon the said John Magan present here in Court in his proper person is at the
prayer of the plfts attorney adjudged to give Speciall Bail to the action afd   thereupon a Certain
Hutton Hill of Somersett County planter present here in Court undertakes for the said John Magan
that if in case the said John Magan shall be therein Convict that then he the said John Magan
that if in case the said John MccClester shall recover Judgm.t against the said John Magan in ye
plea afd or that the said John Magan shall be therein Convict that then he the said John Magan
shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sherr
of Somersett County in satisfaction thereof or that he the said Hutton Hill will do it for him
thereupon the said John Magan by George Dashiell his attorney appears and Imparles till next
Court &c

     Memorand.m the plft by Levin Gale his attorney sued Out his Lordships
writt of Screfacias against the deft.s the tenor whereof followeth in these
words fol viz.t    Somersett fs    Charles absolute Lord and proprietarie
of ye provinces of Maryland and Avalon Lord Baron of Baltemore &c   To the Sherr of Somersett County Greeting
whereas a Certain Benjamin Wailes of Somersett County Quando sher Lately in Our County Court of
Somersett here to witt the fifteenth day of march ann.o Dom one thousand seven hundred and twenty
five before the worshipfull samuel Hopkins and his associates then Our Justices of Our said
