be Levied of you Body's goods or Chattles Lands or tenements for ye use of ye said Henry Fitzwaters in Case the said Jos: MaClester Shall not pay & Satisfie to ye said Henry Fitzwaters the said two thousand five Hundred & fifty pounds of tob.o so as afd recovered against him with ye Additional Costs thereon ^on^ the 10th Day of Feb.ry Next Taken the Ninteenth day of June Anno 1729 Will.m Planner John Smith
Now is & Gives the Court to understand & to be informed that a Certain Robert Scott Late of allhollows Parish in Somrsett Co.ty Planter on ye fourteenth Day of aprill Anno Dom one thousand seven Hundred & twenty Nine with force & Arms &.a at ye parish afd in ye Coty afd within the Jur of this Court in & upon a Certain Achsah Lawrence in ye peace of God & our Said Lord proprietor then & there being an assault Made & her did Beat wound & Evilly treated so that of her Life it was Dispair'd & Other Harms to Her then & there Did do to the Great Damage of the said Achsah Lawrence & against the peace of our ^said^ Lord proprietor his Good rule & Dignity Wherefore ye said Geo: Dashiell for our S.d Lord proprietary prays Advisement of the Court therein the premises & that Due Process of Law may Issue G Dashiell P.r Lord prop.r Thereupon Command was given to the Sherr of Somersett County that he should take the Said Robt Scott if &.c to answer &.c And afterwards to witt the Seventeenth day of June Anno Dom One thousand Seven hundred and twenty Nine before Our Justices here at dividing Creek in somersett County Cometh the aforesaid Robert Scott in his proper person and pr hath a hearing of the Information afd thereupon he says that he is not Guilty thereof and of this he puts himselfe upon the Country and George Dashiell who for his said Lordship in this behalfe follows likewise And afterwards the said Robert Scott in his Own proper person present here in Court prays Relinquisheth his verification afd says that he is Guilty of the trespass and assault afd above upon him Imposed &c Wherefore it is Considered by the Court that the afd Robert Scott be taken ^to^ Satisfie his said Lordship of his fine by Occasion of the trespass and assault afd which same Robert Scott then and there present in Court afd prays that he may be admitted at fine with his said Lordship by occasion afd and thereof he putts himselfe in mercy of his said Lordship and the fine of the Same Robert Scott by the Justices afd is assessed to five hundred pounds of tobacco to the Use of his Said Lordship &c Thereupon the afd Robert Scott is discharged from his recognizance Entered into to answer as abovesaid and is ordered to give New recognizance for his good behaviour and appearance at next Court &.c Whereupon the said Robert Scott with John Pope his Security both present here in Court in their proper persons acknowledged themselves to owe and be indebted |
