196 to be our Commissioners to Examine Evidences on behalfe of a Certain James Hayman of the County afd in relation to the bounds of a tract of Land Containing three hundred and fifty acres Lying in the County afd Called Hopewell we therefore require you or any three or two of you at some time and place as to you or any three or two of you shall Seem Convenient you meet on the aforesaid Land Called Hopewell (you first haveing Taken your Oath on ye Holy Evangelist of Almighty God According to act of assembly in Such Case made & provided) & there Cause to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by ye said Complanient (or Deft if any) & that you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on ye Holy Evangelist of Almighty God In ye Prsents of ye Complanient (or Deft if any) touching ye truth or remembrances of their Knowledge or any thing that may relate to ye Cause afd & that reduceing ye Severall Depositions into Writing you send ye same together with this our Commission under your or any three or two of your Hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Saml Hopkins Gent Chief Justice of our Said Court &c On the Backside of the foregoing Commission it was thus Endorsed viz.t The Execution of this Writt you may see by a Certain Deposition taken before us this 7.th Day of September 1729 And herewith returned Geo: Dashiell Tho.s Gillis Somrsett Co.ty fs: Depositions of Wittnesses taken at ye House of Sarah Hayman at ye Land Called Hopewell in Somrsett Co.ty afd the Seventh Day of Septem Anno Dom One thousand Seven Hundred & twenty Eight by Virtue of a Commission Issuing out of his Lordships Co.ty Co.t of Somrsett to us Directed for ye Examining of Wittnesses to perpetuate ye Bounds of ye Said Land Called Hopewell According to Act of assembly in Such Case provided Vizt William Adley Aged thirty Years or their abouts be Sworn on ye Holy Evangelist of Almighty God in relation to ye Bounds of ye said Land Called Hopewell saith yt he was sold by William Hayman that there was a marked Gum Standing in ye Swamp near Sarah Hayman's Plantation that was a Corner tree of ye Land Called Hopewell & yt he walking the Woods Near ye Said Plantation found a marked Gum according to ye Discription Given him by Will.m Hayman which this Deponant did Expect was ye Gum Mentioned by Said Hayman & third Bound.r of S.d Land Called Hopewell & further Saith not Wee the Commissioners being Caried to ye said Gum of ye request Will.m Adley of Jam.s Haymen son of Sarah Hayman we reversed the Course in Ord.r to find ye first Bound.r & we find by reversing ye said Line that ye first Bound.r Should Stand in ye old field of Tho.s Breretons where he now Lives Near a branch & ye Great Savannah & ye said Jam.s Hayman Caused ye Line to be run from ye Gum afd According to the Course and Distance in the Pattent which run to an Old pine Stump Marked plain with Notches on four sides which was Expressed in the Pattent as the fourth Bound.r which we thought was soe it agreeing both with Course and Distance in which pine Stump there was in our Prsents a Sasiafras Staked Marked with 16 Notches & Sett (up) |
